Insubordination, conduct unbecoming an officer, consorting with the enemy as defined by Sir Varner PferdRitter, High Justice, on the Day of Freedom, 25th the Month of the Dark Shades (Tue Jan 21 17:24:20 2003), for the hearing of Sir Presten dePayens.

Insubordination:

A member of Gareth Keep who refuses or fails to obey an order given by a superior, or if unduly delays carrying out such order. He shall not be sentenced if it is clearly apparent the order has nein bearing on the duties of the office.

The context which the charge was brought about was for refusing to obey an order to uniform properly.

Plea: Guilty

Verdict: Guilty

Conduct unbecoming an officer:

For the purpose of this trial: An action or behavior in the unofficial or private capacity which seriously compromises the persons standing as an officer.

The context which the charge was brought about was for challenging General Perion in public. Challenging him in front of the nonofficers. Disrespectful to their fellow officers in a public forum.

Plea: Not Guilty

Verdict: Guilty

Notes: Some consider insubordination in itself reason enough to decommission an officer. It is not appropriate to openly dispute an superior officer, to be insubordinate, or to be disrespectful to your fellow Knights. There is a proper time an place to handle disputes. Heated discussions occur but are not to be held in public. It goes fur Knights, an more so fur officers. The position of Lieutenant commands respect in its own accord. When your actions jeopardizes the position, it hurts the chain of command. It hurts Gareth Keep. - Sir Varner PferdRitter

Consorting with the enemy:

A member of Gareth Keep who unlawfully dispatches a message to, or otherwise enters into contact with a member of the enemy to establish contracts which violate Gareth's policies or undermine the safety and integrity of the clan.

In this instance, while in exile for disobeying General Perion's orders, Presten negotiated peace with the Conclave and Talon who the Knighthood was at war with at the time. He did not wish to battle them as they were political enemies of the Knighthood, and not true evils of the land. He kept this treaty with them for a time after returning from exile, while awaiting trial and ranked as a Knight of Gareth. He did not return to aggression with them until members of those clans allegedly insulted the Knighthood and Presten's uncle, Sir Aenarion.

Plea: Not Guilty

Verdict: Guilty with special circumstances

Notes: On the charge of consorting with the enemy, I find Sir Presten guilty with special circumstances. I find nein malice in his intent. Misguided perhaps but not with the intent to harm Gareth or its members. I find it wrong to pursue the treaty [with the Conclave] even after Presten was reinstated as a Knight. Active or not. When a recruit is guilded into the halls he assumes the responsibility of all Gareth's policies immediately aftervards. He may have negotiated treaties during his travels alone but by walking into these halls, he gives those up. He no longer just represents himself. Sentance:

Returned to squireship under a knight in good standing and not be returned to knight until such a time as it is proven his conduct is satisfactory.

To write a note of apology to all officers.

Placed in exile for an undisclosed amount of time that could be from one hour to one year at the Crown's discretion.

Circumstances:

Accused of distributing boards milled with funds from the

Keep crafting circle to the benefit of those beyond the

Keep, prejudicing the efforts of the Keep to maintain a

sustainable crafting effort. Verified by Darlen, who received

the boards and paid funds to a third party.

Verdict:

Guilty.

Sentence:

Dishonorable discharge from the Keep.

Outcome:

Ser'cye retired. Forever barred from entry.

Witnesssed removing materials from the racks. Retired

under suspicious circumstances to trade for her own account.

Witnessed by Sir Kahnin Nahbeh. Tried in absentia.

Guilty.

Sentence:

Dishonorable discharge.

Outcome:

Name stricken from the rolls. Forever barred from entry.

Sir Kader Malory faced a tribunal of the Keep to face charges presented by

Captain Branzol Snowdragon, on behalf of the Lance. Colonel Datai Amberillo

and Captain Caenarfon Corwen presented the defence.

The defense stipulated to the charges, acknowledging that Sir Malory passed

items to a troll barbarian of Darknonin on the instructions of a third party

without questioning said instructions as required of a knight, or consulting

with any other of the Keep.

The defense offered in mitigation that Sir Malory acted to further the cause

of the broader Light, given that this troll intended to serve in the Wrath of

Justice.

Recent precedents cited by the acting High Justice, General Rithor Thorne

indicated a sentence of being expelled from the Keep for knowingly violating

standing orders of the Keep.

In light of Sir Malory's admission of guilt for not questioning the request

made of him, the Crown found mitigation to Sir Malory deliberately violating

Keep regulations.

However, Sir Malory was found to be unfitting of discharging the duties of a

knight, having, in this situation, absconded the level of responsibility

demanded of him.

The Crown ruled that Sir Malory is to be demoted to the rank of squire, and

a period of probation in place for a period of 3 months by the old calendar.

Should Squire Malory violate any other rule of the Keep, or act in a manner

unbecoming a member of Gareth's Keep, he shall find himself facing expulsion

from the Keep.

Gentlemen and ladies,

Find following the findings of the hearing against Sir Branzol

and judgment.

Sir Branzol was charged with reckless action in the matter of

removing the blessing from a holy weapon at the request of a

member of another clan, an action unbecoming of an officer and

senior knight of this Keep.

He was further charged with insubordination and unknightly

conduct in the manner in which he responded to orders issued

by the commanding officer of the Order of the Lance.

Sir Branzol was found guilty of the reckless action, mitigated

by his intention, which I believe to have been genuine but

taken advantage of by those of the Wrath who abused it.

Sir Branzol is found not guilty of insubordination, but guilty of

conduct unbecoming, given the manner in which he chose to address

his disagreements with his commanding officer.

Sir Branzol submitted to my judgement and waived his rights to a

formal hearing.

Sir Branzol is demoted to the rank of Captain in the Lance

as a consequence of his conduct unbecoming.

Sir Branzol is further demoted to the rank of Knight:Lance

as a result of his reckless action for choices unbecoming of

an officer. However, given Sir Branzol's long service, and

dedication to this Keep, this sentence is suspended with

two conditions:

1. Captain Branzol must make full restitution to Lord

Thorne for the weapon - i.e replacing it with an

identical weapon.

2. Captain Branzol will under go a period of probation

while this restitution is pending. Any improper

conduct will see this sentence applied.

This restitution is expected to be completed in full

within 3 months, by the old calendar.

Officers of the Keep,

Sir Snowdragon, as an outcome of a disciplinary hearing, was allowed 3

months by the old calendar to make full restitution of loss to a knight of

the Keep.

He has been unable to do so, and thus must now face the enforced terms of

the probation.

Sir Snowdragon is relieved of all officer responsibilities, as well as

duties of Weaponsmaster. He remains, however in the Lance.

This matter is now considered closed.

This day, Day of Freedom, 25th the Month of the Great Evil, Sir Branzol

Snowdragon was called to account for slaying a loner who did not war the

Keep.

He presented a different account of events to what was rendered by Lady

Datai who was present at the time of the loner's slaying.

When challenged on this, his response was that he did care to be questioned

for this actions.

These circumstances leave me assured that the cause of this Keep and that of

Sir Snowdragon are irretrievably broken down.

He is to be removed from the Keep.

May he find a place to serve whose authority he is prepared to accept.

This order is to be executed when Sir Snowdragon next presents himself.

wanting.

Before the sentence could be carried out, he retired from duty.

I will hope that Master Snowdragon will find himself able to continue to

serve the Light from a place with whose ideals he has fewer differences.

This knight chose the cowards way out when faced with a situation he did

not like. He choose to scribe an letter insulting senior officers of this

keep. Then run to the one office left who stood by him to get an

"honorable" discharge.

He is not welcome back in this keep. The next officer to see him inform him

that he may not claim to be a member of this keep in any manner. If he

refuses please inform myself so than an appropriate proclamation be be

scribed.
