February Sessions 1820

In the name of God Amen - Lexington - I James Womack of the county of Rowan & state of North Carolina being very weak and sick in body but of perfect mind and memory do you make this my last will and testament in the following manner and form -

First I will that all my just and lawful debts be paid.

Second I give and bequeath unto my beloved wife Polly all my estate for the maintenance & schooling of my children to be at her disposal and discresion during her natural life or widowhood. At the expiration of either of the above-mentioned terms to wit - natural life or widowhood - my lands to be divided equally between my sons Wilson, Isaac and James Newton - the balance left to be divided between my daughter, my wife into have one third or a daughters part; if any remainder after the daughters is made equal with the price of the land which is to be appraised to be equally divided amongst the whole family.

Lastly I appoint and ordain Hezekiah Owen and William W Wiseman my trusty friends to execute this my last will and testament, confirming this & no other to be my last will, in witness whereof I have hereunto set my hand & seal this 15th day of January - one thousand eight hundred & twenty.
