Lunenburg Co, VA OB 4:105 - Feb Court 1756. Mary Womack an Infant under the age of Twenty one Years who sues by Margaret Womack her mother & next Friend, Complainant, against Richard Womack, Defendant, In Chancery. By Consent of the said Complainant by her attorney the Bill aforesaid is Dissolved.

Lunenburg Co, VA OB 1759-1762:15 - July Court 1759. Jacob Womack obtained Letters of Administration on the estate of Richard Womack deceased with Clement Read Jr his security.

Humbly complaining sheweth unto you Worships your daily oratrix Margaret Womack widow & Relict of Richard Womack jr deceased late of the this County that you oratrix in [illegible] Month of June in the year of our Lord one thousand seven hundred and fifty three intermarried with one Richard Womack Jr of the County of Lun[enburg], that Richard Womack Senr Father to you oratrix's Husband for the support & maintan[ance] of his Son Richard and your oratrix did the Christmas following your Orarix's Marriage by Bill of Sale bearing the Date the 27th Day of December 1753, give & deliver to the said Richard your oratrix's late Husband a Negro Woman named Tabb & did warrant the said Negro her increase to the sd Richard [illegible] Reference being had to this Bill may more fully appear which is now in your custody and oratrix prays to be made part of her Bill of Complaint, your oratrix further shows that March 1754 the said Richard your oratrix's husband departed this Life, without having made a will and left your oratrix pregnant with Child, who was delivered the first Night after the said Richard's Death & was most cruelly treated by your oratrix's Husbands Father, that the sd Richard Womack Senr deserted your oratrix of all her Husband's Estate, the Negro Wench being at that Time run away, that your oratrix paid all her Husbands just Debts mostly by her own Industry, - TODO - complete transcription

Womack vs Womack, Bill Chy [Chancery], 1762 Nov Dec

To the worshipful Court of Prince Edward County sitting in chancery. Humbly complaining sheweth unto your worships your oratrix Margaret Womack widow and Relict of Richard Womack Jr dec’d late of this County that your oratrix in or about the month of June in the year of Our Lord 1753 intermarried with one Rich’d Womack Jr of the county of Lunenburgh; that Rich’d Womack Sr father to your oratrix’s husband for the support and maintenance of his son Rich’d and your oratrix did the Xmas after said marriage by Bill of Sale bearing date 27th of December 1753 give and deliver to the said Richard your oratrix’s said husband a negro wench named Tabb and warrant the said negro and her Increase to the said Richard and his Heirs forever. Reference being thereunto had may more fully and as Large appear, which your oratrix prays may be made of this her Bill of Complaint. Your oratrix further shows that March 1754 the said Richard your oratrix’s husband the departed this life without having made a will and left your oratrix pregnant with Child of which She was delivered soon after his Death -- which Child is since dead, your oratrix further shews that the said Tabb had two Children Sarah and Sam of of which your oratrix conceives she is entitled to by Act of Assembly by the Death of the said Child. But now so it is may it your worships that the said Richard Womack the Elder, combining and confederating with Jacob Womack to whom he has given the said Slaves refuse to give up to your oratrix either of the said Children but hath removed this same to No Carolina and threatens to convey the said Sarah and Sam out of your oratrix’s reach. In tender Consideration whereof and for as much as your oratrix is without remedy save only by the aid of this Court. To the end therefore that the said Richard and Jacob may on their oaths full true and perfect answer make to all and singular the premises as particularly and distinctly as if the same were herein again repeated and interrogated and that said Rich’d may set forth whether your oratrix did not marry the afsd Rich’d his Son; whether he did not give such Negro, & whether she has not since Increase Sarah and Sam; whether your oratrix had not a Child by his sd Son, and why he refuses to deliver one of them to your oratrix, whether he hath not conveyed them to his son Jacob in order to defeat your oratrix, whether your oratrix has not lost the said Child by Death that the said Jacob may set forth whether he has not the said to slaves in his custody and that the said Richard may be decreed to deliver to your oratrix one Moiety of the said slaves or be compelled to pay your oratrix the value thereof and cost & C.

Depositions of Charles Harris and Henry Carrier

The Deposition of Charles Harris of lawful Age being first sworn upon the holy Evangelist of Almighty God deposeth and saith, that he was at Mr Richard Womack's the Deft House and saw an old Gun which the sd Womack said was left to his son Richard the Complainant by his Grand-Father, but that he had an Inclination to give his son Richd a Rifle for her, as he imagined it woud suit him best, and further this Deponent saith not.

The Deposition of Henry Carrier of lawful age being first sworn saith that he hapned at Mr Richard Womack the Deft & the plt Mrs Womack produced him a Note from Mr Nash, with him she had been to ask [?] about this Dispute, as the Deponent understood, and Mr Richard Womack reply'd that Mr Nash might wipe his Backside with it, for as the Widow had refused his offer, he is bond [?] not to do any Thing more, & further this Deponent saith not.

Deposition of James Archdeacon

The Deposition of James Archdeacon of lawful age having first sworn upon the holy Evangelist of almighty God deposeth and saith that he heard old Richard Womack say that he had given his son Richard Womack land in Halifax containing four hundred acres and to the best of his knowledge he heard old Richard Womack say that he had given his son Richd his negro wench Tabb for one hundred acres of the four hundred in Halifax; and after young Richd Womack came down and told his Father that he would rather live in Lunenburgh and that he would swap land with him and desired acre for acre but Richd Womack Senr reply'd he would not give acre for acre but he would give his son two hundred acres in Lunenburgh for his three hundred in Halifax which was agreed to by the parties, and after the young Richd came down and settled the land in Lunenburgh adjoining the sd Richd the Elder & Mr Watkins; the Depon't saith that at the Time of the agreement the said Tabb the wench was run away; but this Deponent saith that he does not know that there were any Conveyances made of any of the Lands, and further the Deponent saith not.

The Deposition of Elce Archdeacon of lawful age having first sworn upon the holy Evangelist of almighty God deposeth and saith that she heard Richard Womack Senr say that he believed she had heard of the negro wench Tabb and was surprized that Peggy Womack the plt [plaintiff] did not look after her, for he believed she might be bad, which Discourse happened after the Death of young Richd Womack and further the Depo saith not.

Deposition of Mary Moore

The Deposition of Mary Moore wife of Geor Moore being first sworn upon the holy Evangelist of Almighty God deposeth and saith, that Richard Womack quartered at the Deponent's House in his way home with the sd Wench Tabb and that this Depo said he had good Fortune to get his Wench that had been so long run away, he reply'd that either she was not his or that he woud give it up to Peggy & recalling his word said that is to the Child this Deponent doth remember and further this Deponent saith not.

Deposition of William Watkins

The Deposition of William Watkins of lawful age being first sworn saith, that he did ask Richard Wamack the Deft why he did not sell the sd Wench called Tabb as she was such a Runaway, he reply'd he had no right for that he had given her to his son Richard already, but this Depo doth not remember whether the said Richd his son was then living or not, but believes he was living, further this Depo saith that heard Richard Wamack Deft say that had swaped Land with his son, for he had given him land where he lived for his Land on Sandy River, and further this Depo saith not.
