Executor's Sale

Pursuant to the Last Will and Testament of Michael Dickson, deceased, will be sold to the highest bidder, at the Court-house in Hancock County, on the first Tuesday in December next, between the usual hours, the Life Estate of Martha Howard, formerly widow of said Michael Dickson, deceased, in and to one hundred and twenty-five acres of land in the county of Hancock, adjoining lands now occupied by William Womack and others, whereon Nancy Womack now lives, which Life Estate accrued by virtue of the Last Will and Testament of Abram Womack deceased, said Martha Howard being the widow of said Abram Womack at the time of her intermarriage with said Michael Dickson, deceased. Will of Sherwood Womack

Georgia, Hancock County

In the name of God Amen. I Sherwood Womack being in low health and weak in body but in sound mind and memory do this day make constitute and declare this my last will and testament. I first give and bequeath my soul to Almighty God who first gave it.

Item 1st. I request my body to be decently buried.

Item 2nd. I request all my just debts paid as soon as funds can be obtained to discharge them.

Item 3rd. I request and bequeath that all my property both real and personal shall be kept together on the plantation under the direction of my Executors.

Item 4th. I hereby request and direct that all my children together with my beloved wife Nancy Womack shall all share and share alike out of my estate, viz, Willie Womack, Mary Womack, Rebecah Womack, Sally Womack, Patsey Womack, Nancy Womack, Lucreasy Womack, Abraham Mitchell Womack, Sherwood Rogers Womack and Aley Rogers Womack, making in all eleven distributive shares.

Item 5th. I request and direct that when any of my children becomes of age or marry’s that five good respectable citizens shall come together and value all my property both real and personal and an equal part assigned over to the one coming of age or marrying and so on till the youngest comes of age or marries.

Item 6th. I request my Executors when funds will admit to purchase as much land lying in the neighborhood as will make up to my present land where I now live twenty two hundred acres so that each distributee may have two hundred acres for a settlement giving my beloved wife her choice of settlement.

Item 7th. I request and authorise my Executors to sell any property which in their judgement ought to be sold or would not be beneficial to the interest of my estate and also request them to purchase any property which will advantageous to my estate,

Item 8th. I request all my children to stay with their mother and that they all receive a good English education.

Item 9th. I request that all my property be under the direction and control of my beloved wife Nancy Womack whom I constitute and appoint my lawful Executrix together with my sons Willie Womack, Abraham M Womack and Sherwood R Womack as they respectively become of lawful age to qualify as Executors and direct that my children all be clothed, schooled and supported out of the estate until they respectively come of age or marry’s and receives their respective proportions of the estate as before directed.

Item 10th. I request and direct that my daughter Nancy Womack do have a certain Negro girl belonging to my estate by the name of Harriot this girl to be valued & to go in as a part of her distributive share with the rest of my legatees the valuation and delivery of this gorl Harriot to my daughter Nancy shall be when she receives her other property from the estate and provided said girl Harriot dies before my daughter Nancy marries or comes of age she shall have her part equal with the rest of my legatees.

Item 11th. I request & order that two old negro fellows by the names of Ned & Bill stay with my beloved wife Nancy during their natural life & they are not sublect to any dividend in my estate.

The last will and testament of Shearwood Womack was proven in open court by the oaths of Reuben T Battle and William Womack two of the subscribing witnesses to said Will and ordered to be recorded, and Nancy Womack nominated Executrix was duly qualified whereupon it is ordered that letters testamentary be granted to her accordingly.
