A parent or guardian has the right to be present at and to participate in all portions of Planning Placement Team meetings, at which an educational program for the child is discussed, developed or written. Parents must be given the opportunity to become aware of the relevant factors involved in the child’s present educational placement and to participate in the evaluation and planning process which may result in a decision regarding a change in the child’s educational placement. Opportunity is also accorded parents to exercise their right to the protection of due process procedures if they do not accept the actions proposed.

The parent or guardian shall be given notice at least three school days prior to a planning and placement meeting. Consideration shall be given to the parent as well as to professional staff in the scheduling of such meetings. If the parents cannot be reached for oral communication and they also fail to respond to written communication, within fifteen days a letter shall be prepared and sent to them via certified mail. The letter shall state the purpose of the meeting, i.e., to discuss the educational status of the child, shall arrange for the meeting at a mutually convenient time and place, and shall include those points of information delineated by Public Law 93-380.
