Pop Tart Lawsuit

In late August of 2021, a class-action lawsuit was filed by Anita Harris against the breakfast brand Kellogg’s for not containing enough real strawberries in their Frosted Strawberry Pop-Tarts. Harris argues that the company, in its labeling and marketing tactics, is portraying a greater amount of strawberries in the product than it actually contains. According to Today News, the “plaintiff would not have purchased the product if she knew the representations were false and misleading.”


The package advertises the strawberries as the primary ingredient, however dried strawberries do not appear on the ingredients until the ‘less than 2% section.’ In addition, the lawsuit also states that the Pop-Tarts contain a red dye called Red 40, which gives the false appearance of pure strawberries. What makes this advertising particularly deceptive is the fact that it contains a relatively large amount of non-strawberry fruit ingredients such as dried apples and pears.

Spencer Sheehan, the attorney representing Harris, told Today News that the intent of the lawsuit is to have this product labeled in a more authentic way. He says, “If it doesn’t have mostly strawberries, if it’s mostly pears, then you know, just call it pear Pop-Tarts. I don’t know why you have to call it strawberry if it is a mix of pears and apples and strawberries.”
