Neil provided a synopsis of the history of revisions to the AR and G/P since September 2023 as well as the proposals to amend the documents currently in effect (dated 8/12/24) that have been presented to the Council during FY25.
The proposal currently before the Council was prepared by Mike Midgley using solicited input from a variety of stakeholders. The Council agreed this proposal will be considered the baseline proposal going forward and it will be referred to as the "shared Association" version.
Anaka Rivera presented recommendations by the Faculty Senate for revisions to the Guideline/Procedure:
Section III, Appeals, item B, regarding the selection process for standing pool of Appeals Committee members
- On motion and vote, the Council accepted a recommendation to add language, to be composed by Anaka, that clarifies the process and increases transparency.
Section III, Appeals, item B regarding the training and direction of the Appeals Committee
- On motion and vote, the Council accepted a recommendation to add language, to be composed by Anaka, regarding the details of training provided by the Employee Relations Officer (ERO).
Relationship between the Grievance Review (GR) Council and the ERO, and committee transparency
- On motion and vote, the Council accepted a recommendation to add language, to be composed by Anaka, regarding the membership of the GR Council and its committees, as well as requirements for posting Council/committee membership on the ACC Employee Grievance Process webpage.
- For clarity, Neil noted that the GR Council is not recognized as an official shared governance group.
Section IV, Privacy - NDA Clause
- On motion and vote, the Council accepted a recommendation to strike the paragraph regarding non-disclosure requirements for the members of the Appeals Committee and add alternative language to be composed by Anaka.
Anaka noted that some concern had been expressed regarding frivolous filings and potential weaponizing of the grievance process. Neil acknowledged the comment and asked Anaka to propose language to address the concern for discussion at the next meeting.
