We are addressing ADOR's stance regarding the article published by Dispatch today.
The contents of the reported article are reconstructed falsehoods based on speculation, and we plan to take firm legal action against them.
The information covered in the report, such as internal meeting records, job assignments, and personal KakaoTalk conversations, is impossible to handle without cooperation from HYBE and Source Music, and without transmitting false information.
In particular, the public exposure of personal information of trainees whose contracts have already ended and artists who have moved to other agencies, without permission, and the release of related materials including medical records and demo data, constitutes a serious violation of confidentiality and contract terms.
The trainee contracts between Source Music and NewJeans members have already been terminated, and there is no provision in these contracts allowing the use of the trainees' likenesses or voices. Therefore, Source Music’s disclosure of trainee videos through the media constitutes a serious illegal act that infringes on the portrait rights of the NewJeans members. We request immediate action to protect the artists.
Additionally, we criticize HYBE's unethical behavior in providing and fabricating materials, such as illegally obtained private messenger conversations, to defame the subsidiary's representative and media outlets that publish such articles. We will proceed with strong legal action.
Contrary to Dispatch's article, the claim that the debut of Team N was indefinitely delayed due to CEO Min Hee-jin's neglect is far from the truth.
To correct the fabricated information, we disclose an email from 2021 that provides context for the situation at that time.
The "CBO office PT material" mentioned in the email is a draft planning document for NewJeans, referred to as 'N team'/'21 team' at the time, created by CEO Min Hee-jin during her tenure as CBO. It outlines the circumstances in which there were many disagreements over the concept of the new girl group, which was being created through a three-party collaboration.
The timeline is as follows:
March 2020: Big Hit's marketing team proposes a launch strategy for the '21 team'.
CEO Min Hee-jin, then the head of creative, found the direction incompatible and prepared a separate launch strategy herself.
May 2020: CEO Min Hee-jin presents her launch strategy (attended by Chairman Bang Si-hyuk, So Sung-jin, and Source Music officials).
Chairman Bang Si-hyuk praised the PT plan as excellent but deemed it too radical for Source Music’s infrastructure and suggested it be pursued under CEO Min's label.
August 2020: Source Music re-proposes a preliminary plan.
The new plan largely copies CEO Min's May strategy.
Complaints were raised with Source Music and Mr. So Sung-jin, who acknowledged the issue.
As detailed in the email, the launch strategy feedback from Source Music indicated difficulty in implementation. Despite this, the strategy was copied by Source Music, leading to ongoing discussions and difficulties in R&R and production timeline negotiations.
ADOR (then CBO office) did not receive a reply to this email.
We are sharing the official email that was collectively shared at the time, not the edited materials provided by HYBE, to accurately understand the context and correct the false claims.
Although ADOR holds additional evidence, including Slack and KakaoTalk conversations among related parties, we believe it is inappropriate to disclose personal conversations at this time, so we are releasing only the email.
It is incomprehensible that HYBE continues to spread falsehoods and fabrications despite the clear existence of documents and witnesses, including parents and members who experienced these events.
We are appalled that HYBE PR committed serious, undisclosed illegal acts against NewJeans' legal representatives just yesterday, despite being sternly warned.
In May, HYBE's legal team sent CEO Min Hee-jin a notice not to disclose her private KakaoTalk conversations with Chairman Bang Si-hyuk and CEO Park Ji-won. Despite this, HYBE continues its thoughtless actions against ADOR.
CEO Min Hee-jin returned a laptop to HYBE three years ago after initializing it. It is strongly suspected that HYBE performed forensic analysis on this laptop to recover personal conversations, which constitutes a serious crime and illegal act involving the detection of electronic records.
HYBE claims that the conversations were stored on its cloud server rather than being forensically retrieved, which is a more serious issue as it implies continuous collection and storage of private conversations without consent, constituting severe violations of privacy and telecommunications secrecy laws.
These actions by HYBE seriously infringe on the freedoms of privacy and communication, contravening constitutional rights.
CEO Min Hee-jin has already submitted her laptop, owned by ADOR, to the police to clear any doubts.
For transparent investigation, CEO Min Hee-jin requested the police to retrieve and examine the laptop in HYBE's possession.
However, HYBE has not submitted the material to the police, claiming it is stored on the company’s server/cloud rather than being forensically retrieved, which is an even greater crime.
If the data truly exists on the server, HYBE should cooperate sincerely with the police investigation.
The numerous unreasonable media plays and responses by HYBE are infuriating and concerning ADOR and NewJeans’ legal representatives, leading us to take serious action.
The entire article is based on falsehoods, making rebuttal meaningless. The overall distortion of facts and timeline is a severe defamation and obstruction to ADOR, NewJeans, and CEO Min Hee-jin.
We urge HYBE executives to cease unnecessary oppression of the subsidiary, refrain from causing unnecessary disputes, actively cooperate with the police investigation, and avoid further illegal acts.
