AHW: Treatment of public holidays 2020

This briefing is provided to remind members of the agreement negotiated in 2016 for members on AHW.

In 2016 myself and the late Group President, Nigel Buller spent considerable time negotiating with the Home Office over the treatment of substitute Public Holidays. These negotiations concluded during May 2016 and MB 036/16 was issued advising members that, amongst other AHW discussions, PCS had secured agreement on the treatment of substitute public holidays.

MB 036/16 informed members that:

“PCS is pleased to be able to report that it was finally able to persuade the Department to agree to accept the Union’s understanding of the position that where Christmas Day and/or Boxing Day fall on the weekend any attendance made should attract premium payment, as well as the respective ‘substitute public holiday’.

The current draft wording received from management states:

“Following our conversation on Tuesday 24 May, I just wanted to confirm in writing that the Home Office has decided to amend the AHA policy to set out that the public holiday premium rate will apply for both the day itself, and the substitute day, where a public holiday falls at a weekend.

We will ensure managers are clear on this as soon as possible and will seek your agreement to the proposed change to the wording of the AHA policy shortly.”

PCS are pleased to report that this remains the case and this has been confirmed during correspondence with Home Office, although it should be noted that whilst there is credit to premium hours, no further reduction in hours is given for the additional public holiday.

PCS wish to inform members that the recent announcement that the move of public holiday credit from being a reduction on TAMS/Kronos to being held on Metis has not been agreed by PCS, nor has this change been subject of consultation. PCS will be meeting in the near future with Home Office to discuss this change and the implications. Further communication will be issued to members following these discussions.
