If an A/C is firing at an final deflection 150 at a target that is out of its vertical arc, will it actually need a determination check and is there a risk of collision?
The rules are very clear I think - the shot obviously is an "auto-miss". But it is still a head on shot by definition which requires a determination check (since firing or not firing affects collision modifiers). And a head on attack will always generate a danger zone if taken from within CRR, which the planes may try and avoid next move.
The only way out is if the pilot had not declared a shot to begin with. By declaring the shot (auto miss or not) he creates the head on conditions and danger zone. Period.

PS - a collision check only occurs if one or the other subsequently enters the danger zone on the next move.

Does the Danger Zone (10.3) created on GT-16 when the 109 made his range 1 head-on attack at the I-16 (from 3 hexes within the CRR) still exist on GT-17 if the I-16 was destroyed by hits by the head on attack ?
Destroying the target at range 1 eliminates the danger zone for the next turn's move.

Situation : Head on shot declared during movement from Fw190 #1 (Leland) on Yak-3 #6.
Can Yak #6 decline returning fire at Fw190 #1 during movement, and shoot at Fw190 #1 during the normal combat phase ?
Drew is handling it correctly.
A head on attack during the movement phase is only allowed against targets that have already moved and only an FP prior to the mover's final FP.
A head on attack during movement must be declared ("head on during movement")...and the target may respond at the same time as the attacker fires.
There is no requirement for target to respond to head on shot during movement.
The target is not disqualified from firing in the combat phase at the head on attacker or any other a/c in its gun arc in the combat phase.
A head on attack may occur in the combat phase, as defined by the head on parameters, but does not have to be declared, nor does it have to be against A/C that have moved before the head on shooter.

The only tricky part is the CRR and collision check modifiers.
In the case of Leland versus the Yak
Leland does CRR and determination checks based on his range during the movement phase shot.
Yak does CRR and determination check based on range in the combat phase. They will be different due to the different ranges and so will any collision modifiers.
The collision check for entering the DZ must use the collision modifiers that apply to the A/C instigating the check (i.e. moving first).
If the Yak moves first and enters the DZ - use those mods.
If Leland moves first, use his mods.
Only one collision check is required and the DZ is dissolved after that.
