There are many instances where UDOT will enter into agreements with local or state entities as it provides a benefit to the Department, the traveling public, and the entity willing to enter into the agreement. Such an example of an agreement would be the city sweeping UDOT roads that local forces will pass through while sweeping their own city streets. In this case it makes reasonable sense that UDOT would reimburse the local agency. Both entities benefit by entering into an agreement of this type: the city gets reimbursed for the additional miles their sweepers are traveling, the public gets cleaner streets, and UDOT can focus their limited resources on higher-priority routes.
Agreements establish the terms and conditions of what each party is responsible for. Agreements will spell out the length for which the agreement is good for (time frame) and can establish opportunities to extend or cancel the agreement based on conditions that are explained in detail. See the example below for a condition that allows for cancellation of an agreement.
Terms and Conditions in an agreement that allows UDOT to cancel: If UDOT reasonably determines that the park-and-ride facility has become a substantial safety hazard to traffic on I-80, UDOT shall provide the county with written notice and an opportunity to cure the hazard. In the event that the county is unable to cure the hazard, the county shall remove access to the park-and-ride facility and restore the site within 90 days. This agreement shall be terminated upon the removal of the access and the restoration of the site.
Agreements also list the expectations of what each party will do and in some cases provide a detailed description of performance measures that must be met in order for payment to be made. Below is an example that contains performance measures that are identified and spelled out in an agreement.
Performance Measures included in Agreements –Street Sweeping Services within Salt Lake City:
1. Services shall include sweeping fourteen streets (StateRoutes) with varying lengths (Curb Miles) as shown in Exhibit “C,” State Routes and Curb Miles.
2. Services shall include sweeping approximately ten sweeping passes per year, per
State Route as identified in Exhibit “C.”
3. Services shall be substantially of the same quality and scope provided by the City in the Incorporated areas of Salt Lake City.
