If there is a death on the premises, why do need a Death Certificate?

If there is a death on the premises, we are required by law to disclose this material fact for three years after the event. If the deceased did pass away on the premises, we request a death certificate to confirm the date. We also are required to disclose the cause of death on the premises unless the cause of death was AIDS.

California Civil Code Section (CCCS) 1710.2 basically states that a death on a property must be disclosed if it occurred within three years. According to CCCS 1710.2, it is not required to disclose a death on a property if it occurred after the three-year time frame.

If a party interested in the property, asks "How" the person died, we are to disclose it as a material fact UNLESS the person died of AIDS wherein we cannot disclose that fact.
