Article 1. Purpose

These Terms of Service ("Terms") govern the use of the mobile application USA Tunes (the "App") provided by Corp. Exciting ("Developer", "we", "us"). By installing or using the App, you agree to be bound by these Terms.

Article 2. Service Description

USA Tunes is a radio streaming app that helps you discover and listen to publicly available live radio stations across the United States.

The App provides:

- Access to 45,000+ live US radio streams via a public station directory

- Genre-based discovery, search, and favorites saved locally on your device

- Sleep timer and background playback with lock screen controls

What the App Does NOT Provide:

- Hosting, recording, downloading, or offline playback of any radio content

- Cloud storage, backup, or synchronization services

- Any guarantee of stream availability, audio quality, or content accuracy

- Social networking, sharing platforms, or messaging services

Article 3. Stream Sources & Copyright

1. Directory-Based Access

The App uses the Radio Browser open API, a community-maintained public directory of radio streams. The App connects users directly to official stream URLs that broadcasters have publicly published for open listening.

2. No Hosting or Rebroadcasting

The Developer does NOT host, proxy, relay, rebroadcast, store, or technically redistribute any radio or audio content. The App functions solely as a tool that links to each broadcaster's own publicly available official stream.

3. No Unauthorized Acquisition

The Developer does not obtain streams through cracking, hacking, unauthorized extraction, or any abnormal technical means.

4. Third-Party Content & Trademarks

All station names, logos, and broadcast content belong to their respective owners and are displayed for identification purposes only. The Developer is not affiliated with any station or network listed in the App.

5. Takedown Policy

If you are a stream owner and do not wish your station to be listed or linked in the App, contact us with your channel details at the email below. Upon verification, the connection will be removed within a maximum of 30 days.

Article 4. Data Storage & Privacy

1. Local Data Storage

All user data — including favorites, recent stations, and settings — is stored locally on your device only. The Developer does not store personal user data on external servers.

2. No Personal Data Collection

The App does not collect, transmit, or process personally identifiable information (PII). The Developer does not have the ability to identify users as individuals.

3. Third-Party SDKs

The App may include third-party SDKs (e.g., advertising networks) that operate under their own privacy policies. These services may collect anonymized, non-identifiable usage data in accordance with applicable law.

4. Data Usage Restrictions

The Developer does NOT:

- Sell or share personal data with third parties

- Use user data for targeted advertising profiling

- Store user listening history or content on external servers

Article 5. Advertising

The App may display advertisements provided by third-party advertising networks (e.g., Google AdMob).

You acknowledge that:

- Ads are served by third-party providers under their own terms and privacy policies

- The Developer does not control the content of third-party advertisements

- Ad personalization may be subject to your device's advertising settings and applicable privacy laws including GDPR and CCPA

Article 6. Intellectual Property

All design, code, and features of the App itself are the property of Corp. Exciting. Radio broadcast content remains the property of its respective broadcasters. Users are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.

Article 7. User Responsibilities

Users agree to:

- Use the App in compliance with all applicable local, national, and international laws

- Not record, redistribute, or commercially exploit any radio content accessed through the App

- Not attempt to reverse engineer, decompile, modify, or exploit the App

Article 8. Limitation of Liability

To the maximum extent permitted by applicable law:

- The App is provided "as is" without warranties of any kind, express or implied

- The Developer is not liable for any direct, indirect, incidental, special, or consequential damages arising from use or inability to use the App

- The Developer does not warrant uninterrupted or error-free operation of the App, including the availability of any individual radio stream

Article 9. Service Changes

The Developer may modify, update, suspend, or discontinue any features of the App, including the availability of specific stations, at any time without prior notice. Continued use of the App after such changes constitutes acceptance of the updated App.

Article 10. Changes to Terms

These Terms may be updated periodically to reflect changes in the App or applicable law. The updated Terms will be posted within the App. Continued use constitutes acceptance of the revised Terms.

Article 11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Korea. Any disputes arising from these Terms or use of the App shall be subject to the exclusive jurisdiction of the courts of the Republic of Korea.

USA Tunes ("App") is a radio streaming app developed by Corp. Exciting ("we," "us," "our") that helps you discover and listen to publicly available live radio stations across the United States. This Privacy Policy explains what information the App does and does not collect, how your data is stored, and the choices and rights available to you.

USA Tunes is built with a privacy-first architecture:

• No account or sign-up required

• No personal data stored on our servers

• All user data (favorites, recent stations, settings) stays on your device

• No hosting, recording, or redistribution of radio content

2. Data We Collect

Corp. Exciting does not collect, store, or transmit the following to its servers:

• ❌ Name, email address, phone number, or other personal identifiers

• ❌ Your listening history or activity

• ❌ Contacts or personal files on your device

• ❌ Exact GPS location data

• ❌ Device identifiers (IMEI, MAC address)

3. How the App Works (Stream Sources)

USA Tunes uses the Radio Browser open API, a free, community-maintained directory of publicly available radio streams, to connect you directly to each broadcaster's own official, publicly published stream URL.

• The App does not host, proxy, relay, rebroadcast, or store any audio content on its own servers.

• The App does not obtain streams through cracking, hacking, unauthorized extraction, or any abnormal technical means.

• Because playback connects you directly to each broadcaster's own server, your use of a given stream may also be subject to that broadcaster's own privacy practices, which Corp. Exciting does not control.

4. Advertising

USA Tunes may display advertisements provided by third-party advertising networks (e.g., Google AdMob).

• Ads are served by third-party providers under their own terms and privacy policies

• The Developer does not control the content of third-party advertisements

• Ad personalization may be subject to your device's advertising settings and applicable privacy laws, including GDPR and CCPA

• To opt out of personalized ads, adjust your device's advertising settings

5. Third-Party Services

USA Tunes may rely on:

• The Radio Browser open API (public station directory)

• Advertising platforms (e.g., Google AdMob)

• Crash reporting or analytics SDKs, where used, which only process anonymized, non-identifiable data

These services operate under their own privacy policies. The Developer is not responsible for their data practices.

👉 Uninstalling the App permanently deletes all locally stored data.

7. Security Measures

USA Tunes uses:

• Secure app sandbox storage for all local data

• No server-side user database

• No external transmission of your listening activity or personal data

• HTTPS connections for stream playback and third-party SDK communications, where supported

8. Your Rights & Control

You can:

• ✔ Delete your local data at any time by clearing favorites/recents in-app or uninstalling the App

• ✔ Control ad personalization by adjusting your device's advertising settings

9. Children's Privacy

USA Tunes does not knowingly collect personal data from children. Because no account or personal information is required to use the App, and no personal data is transmitted to our servers, the App is not designed to collect information from any user, including children. If you believe a child has provided personal information through the App, please contact us immediately.

10. International Data Processing

Any anonymized data processed by third-party advertising or analytics SDKs may be processed in regions such as the United States, subject to each provider's own policies. Corp. Exciting does not store or transfer personal data internationally, as it does not collect personal data in the first place.

11. Stream Owner Takedown Requests

If you are a station or stream owner and do not wish your station to be listed or linked in USA Tunes, contact us with your channel details at the email below. Upon verification, we will remove the connection within a maximum of 30 days.

12. Changes to This Policy

We may update this Privacy Policy to reflect changes in the App, applicable law, or our third-party service providers. Updates will be posted within the App and/or on the App Store listing. Continued use of the App after changes are posted constitutes acceptance of the revised policy.

13. Disclaimer

USA Tunes is an independent radio streaming app and is not affiliated with any radio station, broadcaster, or network listed in the App. Station names and logos belong to their respective owners and are displayed for identification purposes only. Stream availability depends on each broadcaster and may change without notice. Corp. Exciting is not responsible for the content, availability, or accuracy of any third-party radio stream.

14. Governing Law

This Privacy Policy is governed by the laws of the Republic of Korea, consistent with our Terms of Service.
