1.1 MediSay (the “App”) is a mobile, AI-assisted intake interview and symptom organization app. It helps users summarize and structure their own inputs (e.g., symptoms, timeline, context) to communicate more clearly during a consultation with a qualified professional.
1.2 Features may include:
(a) AI-assisted intake interview via voice or text (symptoms, timeline, context, follow-up Q&A)
(b) Structured summaries and report generation (e.g., timeline, key notes, question list)
(c) General safety notes and informational prompts designed to support safer decision-making
(d) In-app guidance and settings links (Privacy Policy, Terms, support links, developer/app collection links)
2. Informational Use Only — Not Professional Healthcare Services / Not a Medical Device
2.1 All outputs and content provided by the App (including summaries, suggested questions, comparisons, and safety notes) are provided for general informational and organizational purposes only.
2.2 The App is not a provider of professional healthcare services and is not intended to be used as a medical device. The App does not:
(a) determine what condition you have, or confirm what is happening in your body
(b) provide individualized instructions meant to replace a qualified professional’s judgment
(c) provide real-time assessment of risk or severity
2.3 AI outputs may be inaccurate, incomplete, or misleading due to missing details, ambiguous symptoms, user input quality, device conditions (e.g., noise, transcription errors), and limitations of AI. The App does not guarantee accuracy.
2.4 You should use the App to organize information and prepare questions, and consult a qualified professional for decisions regarding your health.
3. Urgent Situations Notice
3.1 If you believe you may be in an urgent situation, seek immediate help through appropriate local services. Do not rely on the App for urgent decision-making.
3.2 The App cannot observe you, measure vital signs, or assess your situation in real time. Any safety prompts are general information and may not reflect your specific circumstances.
4.1 You must use the App lawfully and responsibly and apply common sense.
4.2 You are responsible for the information you provide and for how you use outputs (including what you share with professionals).
4.3 You represent that you have the rights/permissions to provide any content you submit (including respecting privacy and third-party rights).
4.4 You must not submit illegal, harmful, abusive, or rights-infringing content.
4.5 You are solely responsible for decisions and actions taken based on App outputs.
5. In-App Purchases — Consumable Credits (Important)
5.1 The App offers consumable credits via in-app purchases (“IAP”). Credits may be used to access paid AI features such as intake interview sessions and/or summary/report generation.
5.2 Credits are consumable digital items usable only inside the App. Credits have no cash value, are non-transferable, and cannot be sold, gifted, exchanged, or redeemed outside the App.
5.3 Credit usage rules (e.g., how many credits are required per feature, and when credits are deducted) are displayed in the App and may vary by feature. Credits may be deducted when a paid feature is initiated or completed, as shown in the App UI.
5.4 Delivery of credits: After a successful purchase, credits are added to your in-app balance. Delivery may require a stable internet connection and correct device/platform status. If delivery fails, users should verify platform purchase status and then contact support with relevant purchase information (e.g., receipt/order details).
5.5 No restoration for consumables: Because credits are consumable, “Restore Purchases” may not restore credits. Credits may be lost due to reinstalling the App, device change, OS reset, storage clearing, data corruption, platform/account changes, or other factors. To the maximum extent permitted by law, Team EXCITING is not responsible for credit loss in such cases.
5.6 Refunds: Payments are processed by the platform provider (Apple/Google) and are subject to the platform’s payment terms and refund policies. Refund requests must be submitted through the platform’s official refund process. To the extent permitted by law, purchases of consumable credits are final once delivered and/or used, and Team EXCITING does not guarantee refunds.
5.7 Pricing and availability: Team EXCITING may change pricing, credit bundles, credit consumption rules, and availability of paid features at any time, subject to applicable law and platform rules.
5.8 Fraud/abuse: Misuse of IAP (including fraudulent behavior, chargeback abuse, or attempts to manipulate credit balances) may result in suspension or termination of access to paid features, to the extent permitted by law.
6. Data & Privacy (Overview)
6.1 No account/login required: The App may operate without account creation.
6.2 On-device storage: The App may store certain data locally on your device (e.g., intake history, generated reports, preferences). Deleting the App may remove locally stored data.
6.3 AI processing: When AI features are used, submitted content (which may include text and/or voice-derived transcripts) may be transmitted to third-party processing services to generate results, potentially via a proxy operated by Team EXCITING.
6.4 Third-party links: Settings may include links to third-party services (Privacy Policy, support, social channels, developer/app collection links). When opened, your device connects directly to those services and their terms/policies apply.
6.5 Details are governed by the App’s Privacy Policy.
7. Disclaimer of Warranties
7.1 The App is provided “AS IS” and “AS AVAILABLE.”
7.2 To the fullest extent permitted by law, Team EXCITING disclaims all warranties, including (without limitation) warranties of accuracy, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
8. Limitation of Liability
8.1 To the maximum extent permitted by law, Team EXCITING is not liable for any direct or indirect damages arising from use of the App.
8.2 This includes (without limitation):
(a) inaccurate outputs, incomplete summaries, or misunderstandings of App content
(b) reliance on the App for urgent situations or health-related decision-making
(c) adverse outcomes related to delayed consultation or misunderstanding of outputs
(d) service interruptions, connectivity issues, or third-party service outages
(e) loss of consumable credits due to reinstall/device change/platform factors
8.3 Users are solely responsible for how they use the App and for decisions made based on App outputs.
9. Changes, Suspension, Termination
9.1 Team EXCITING may modify, suspend, or discontinue any part of the App at any time.
9.2 Terms may be updated; continued use after changes indicates acceptance of the updated Terms.
10.1 By installing or using the App, you acknowledge that the App’s outputs are informational and organizational only, accuracy is not guaranteed, and you agree to these Terms. If you do not agree, do not install or use the App.
