1. Acceptance of Terms

By downloading, installing, accessing, or using MotionFlow (the “App”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree with these Terms, do not install or use the App.

Team EXCITING may update these Terms from time to time. Continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms.

2. Description of MotionFlow

MotionFlow is a motion-comfort utility designed to display visual motion cues while you use your mobile device during vehicle travel.

Depending on your device and settings, features may include:

• System-wide visual motion cues displayed over other apps

• Motion-responsive dots, lines, flow effects, horizon indicators, and other visual cue styles

• Customizable cue shapes, colors, opacity, size, count, and motion response

• Dark and light themes

• Automatic vehicle activity detection through Auto Ride

• Quick Settings controls

• Foreground ride controls and notifications

• Real-time motion preview

• Multiple interface languages

• On-device motion processing

Features may be modified, added, removed, or redesigned as the App evolves.

3. Not a Medical Device

MotionFlow is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease, disorder, or medical condition.

The App is designed as a visual comfort aid that may help some users feel more comfortable while viewing a screen during vehicle movement.

Effectiveness may vary significantly between individuals, devices, vehicles, seating positions, road conditions, and other circumstances.

MotionFlow does not guarantee the prevention, elimination, or reduction of motion sickness.

If you experience significant nausea, dizziness, headache, disorientation, vision problems, or other symptoms, discontinue use of the App and stop looking at the screen.

Seek professional medical advice when appropriate.

4. Passenger Use and Driving Safety

MotionFlow is intended primarily for passengers.

You must not interact with MotionFlow or other mobile applications while driving or operating a vehicle where doing so would be unsafe or unlawful.

Do not allow the App, visual cues, notifications, controls, or screen content to distract you while operating:

• Cars

• Motorcycles

• Bicycles

• Boats

• Aircraft

• Heavy machinery

• Any other vehicle or equipment requiring full attention

Always follow applicable road, transportation, and device-use laws.

5. Motion Sensors and Device Processing

MotionFlow may use sensors available on your device, including:

• Accelerometer

• Linear acceleration sensor

• Gyroscope

• Device orientation-related sensor information

Sensor information is used to calculate motion cues and visual responses.

MotionFlow is designed to perform motion processing locally on your device.

Team EXCITING does not operate proprietary servers for collecting or storing raw motion sensor data.

Sensor accuracy and availability depend on your device hardware, operating system, orientation, calibration, and manufacturer implementation.

6. Auto Ride and Activity Recognition

MotionFlow may offer an Auto Ride feature that attempts to detect vehicle travel automatically.

This functionality may rely on Android Activity Recognition or Google Play services.

Activity Recognition:

• Does not provide MotionFlow with precise GPS location

• May classify device activity such as being in a vehicle

• May not detect every vehicle trip correctly

• May occasionally activate or stop incorrectly

You remain responsible for manually confirming whether MotionFlow is active when needed.

7. Display Over Other Apps

MotionFlow may require permission to display visual motion cues over other applications.

This permission allows MotionFlow to draw visual elements on top of compatible apps.

MotionFlow does not use this permission to:

• Read text displayed by other apps

• Capture screenshots

• Record the screen

• Access passwords

• Access keyboard input

• Inspect private content from other applications

The overlay is intended solely to display MotionFlow visual cues and controls required for the feature.

You may revoke this permission at any time through your device settings.

8. Foreground Service and Notifications

When MotionFlow is actively displaying motion cues, Android may require the App to operate using a foreground service.

This may result in a persistent notification while MotionFlow is active.

The notification may provide status information or controls such as pause, resume, or stop.

Depending on your Android version and settings, notification permission may be required.

Foreground operation may consume additional battery and system resources.

9. Local Data Storage

MotionFlow may store certain preferences locally on your device, including:

• Selected cue style

• Cue shape

• Cue color

• Motion strength

• Opacity

• Cue size

• Cue count

• Response settings

• Theme preference

• Language preference

• Auto Ride preference

• Other interface settings

Team EXCITING does not have direct access to this locally stored information.

Removing the App may delete locally stored preferences depending on your operating system and backup configuration.

10. Advertising

MotionFlow may display advertisements through third-party advertising platforms such as Google AdMob.

Advertising providers may process information such as:

• Advertising identifiers

• General device information

• App interaction signals

• Approximate region

• Ad impressions

• Ad clicks

• Diagnostic information

Advertising services operate under their own privacy policies and terms.

Team EXCITING does not directly receive your payment information, account credentials, private screen content, or raw sensor data through advertising.

MotionFlow is designed not to intentionally display advertising over your screen while active ride motion cues are being shown.

11. Analytics and Diagnostics

MotionFlow may use analytics and diagnostic services such as Google Analytics for Firebase or related Google services to understand App performance and usage.

Information may include:

• App launches

• Feature interactions

• Session information

• App version

• Operating system version

• General device information

• Crash or performance data

This information is used to improve stability, usability, design, and performance.

Team EXCITING does not use analytics to collect the contents of other applications displayed beneath the MotionFlow overlay.

12. Third-Party Services

MotionFlow may rely on or interact with third-party services, including:

• Google Play services

• Google Activity Recognition

• Google Mobile Ads

• Google Analytics / Firebase services

• Google Play

• External social media or developer links

Third-party services operate under their own terms and privacy policies.

Team EXCITING is not responsible for the independent practices, availability, or policies of third-party services.

13. Device Compatibility and Performance

MotionFlow functionality may differ between devices.

Performance may be affected by:

• Device sensor quality

• Android version

• Manufacturer restrictions

• Battery optimization

• Background execution restrictions

• Display refresh rate

• Orientation

• Overlay limitations

• Third-party applications

• System updates

Team EXCITING does not guarantee identical functionality across all devices.

Use of MotionFlow may increase battery consumption or system resource usage while active.

14. User Conduct

You agree not to:

• Use MotionFlow unlawfully

• Attempt to bypass security controls

• Exploit or interfere with App functionality

• Reverse engineer the App except where expressly permitted by applicable law

• Redistribute modified versions without authorization

• Use the App in a manner that endangers yourself or others

• Misrepresent MotionFlow as a medical treatment or certified medical device

15. Intellectual Property

MotionFlow, including its software, interface design, graphics, branding, animation systems, visual cue designs, and related materials, is owned by or licensed to Team EXCITING.

These Terms grant you a limited, personal, non-exclusive, non-transferable license to use MotionFlow for its intended purpose.

No ownership rights are transferred to you.

16. Availability and Changes

Team EXCITING may:

• Update the App

• Modify features

• Add or remove cue styles

• Change compatibility requirements

• Modify supported languages

• Change advertising implementation

• Temporarily suspend features

• Discontinue the App

We do not guarantee uninterrupted or error-free availability.

17. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOTIONFLOW IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TEAM EXCITING MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES REGARDING:

• MERCHANTABILITY

• FITNESS FOR A PARTICULAR PURPOSE

• MEDICAL EFFECTIVENESS

• MOTION SICKNESS PREVENTION

• SENSOR ACCURACY

• DEVICE COMPATIBILITY

• ERROR-FREE OPERATION

• UNINTERRUPTED AVAILABILITY

MOTION CUES MAY NOT PROVIDE THE SAME EXPERIENCE OR RESULT FOR EVERY USER.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TEAM EXCITING SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE USE OF MOTIONFLOW.

THIS INCLUDES, WITHOUT LIMITATION:

• MOTION SICKNESS OR PHYSICAL DISCOMFORT

• DISTRACTION

• DEVICE MALFUNCTION

• BATTERY DRAIN

• DATA LOSS

• APP COMPATIBILITY ISSUES

• SENSOR INACCURACY

• VEHICLE-RELATED INCIDENTS

• THIRD-PARTY SERVICE FAILURES

Nothing in these Terms limits liability that cannot legally be excluded under applicable law.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Team EXCITING and its affiliates from claims, damages, losses, or expenses resulting from misuse of the App or violation of these Terms.

20. Termination

You may stop using MotionFlow at any time by uninstalling the App.

Team EXCITING may restrict or discontinue access to the App where reasonably necessary for security, legal compliance, maintenance, or service discontinuation.

21. Governing Law

These Terms are governed by applicable law.

Where legally permitted, disputes should first be addressed through good-faith communication between the user and Team EXCITING before further legal proceedings.

Nothing in these Terms removes mandatory consumer rights available under applicable local law.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect.

23. Entire Agreement

These Terms and the MotionFlow Privacy Policy constitute the agreement between you and Team EXCITING regarding use of the App.

1. Overview

MotionFlow (“the App”) is a motion-comfort utility that displays visual motion cues while users view their mobile device during vehicle travel.

This Privacy Policy explains what information may be processed when you use MotionFlow, why it is processed, and how your privacy is protected.

MotionFlow is designed around data minimization.

Core motion processing is performed locally on your device, and Team EXCITING does not operate proprietary servers for collecting raw motion sensor data, activity history, or screen contents.

2. Information Team EXCITING Does Not Collect

MotionFlow does not require or independently collect the following information for its core functionality:

• Your name

• Phone number

• Home address

• Government identification

• Contacts

• SMS messages

• Call logs

• Email account contents

• Precise GPS location

• Location history

• Camera images

• Microphone recordings

• Stored photos or videos

• Files stored on your device

• Screen recordings

• Screenshots

• Passwords

• Keyboard input

• Content displayed inside other applications

• Banking or payment card information

MotionFlow does not require user account registration.

3. Motion Sensor Data

MotionFlow may access motion-related sensors available on your device, including:

• Accelerometer

• Linear acceleration sensor

• Gyroscope

• Orientation-related sensor information

This information is used to calculate visual motion cues.

Examples include detecting:

• Acceleration

• Deceleration

• Lateral movement

• Directional changes

• General device movement

Raw sensor information is processed locally on your device.

Team EXCITING does not transmit raw motion sensor measurements to proprietary Team EXCITING servers.

MotionFlow does not create a route history from sensor information.

4. Activity Recognition and Auto Ride

If you enable Auto Ride, MotionFlow may request Activity Recognition permission.

This feature may use Android or Google Play services to determine whether the device appears to be traveling in a vehicle.

The App may receive activity classifications such as:

• IN_VEHICLE

• Entering vehicle activity

• Leaving vehicle activity

Activity Recognition does not require MotionFlow to access precise GPS coordinates.

MotionFlow does not use Auto Ride to create a travel history or map your routes.

You may disable Auto Ride or revoke Activity Recognition permission at any time through the App or system settings.

5. Display Over Other Apps Permission

MotionFlow may request Android's “Display over other apps” permission.

This permission is used to display motion cues over applications such as:

• Browsers

• Video applications

• Social media applications

• Reading applications

• Other compatible apps

MotionFlow does not use the overlay permission to read, inspect, copy, capture, or store the contents of those applications.

The overlay itself is designed to display MotionFlow-generated graphics only.

MotionFlow does not use Android Accessibility Services for its core overlay functionality.

6. Foreground Service and Notification Permission

MotionFlow may use an Android foreground service while motion cues are active.

This allows MotionFlow to continue displaying cues when another application is in the foreground.

Depending on your Android version, the App may request notification permission to display ride status and controls.

Notification-related processing may include:

• Active ride status

• Pause control

• Resume control

• Stop control

This information remains associated with App operation and is not used to profile you.

7. Information Stored Locally

MotionFlow may store App settings locally using device storage mechanisms such as SharedPreferences.

Examples include:

• Theme preference

• Language

• Cue pack

• Cue style

• Cue shape

• Cue color

• Cue opacity

• Cue size

• Cue count

• Response settings

• Motion strength

• Auto Ride preference

• Setup status

This information remains on your device unless your operating system backup system copies App data as part of its normal backup process.

Team EXCITING does not directly access locally stored preferences.

Uninstalling MotionFlow will normally remove locally stored App data, subject to your device and backup configuration.

8. Analytics

MotionFlow may use Google Analytics for Firebase or similar Google analytics services to improve App quality and understand general usage patterns.

Analytics information may include:

• App launches

• Session events

• Feature interactions

• General device model information

• Operating system version

• App version

• Language or general region settings

• Crash information

• Performance information

Analytics data is not intended to include:

• Raw motion sensor streams

• Precise location

• Content displayed in other apps

• Passwords

• Personal messages

• Screen recordings

• Route history

Analytics processing is governed by Google's applicable privacy policies.

9. Advertising

MotionFlow may include third-party advertising services such as Google AdMob.

Advertising SDKs may process certain technical information for ad delivery, fraud prevention, measurement, and personalization where permitted.

This may include:

• Advertising ID

• Device information

• IP-derived approximate region

• App interaction information

• Ad impression data

• Ad click data

• Network information

• Diagnostic information

Team EXCITING does not independently store raw Advertising IDs on proprietary servers.

Where required by law, advertising consent or privacy controls may be presented.

You may also manage advertising personalization through your device or Google account settings.

10. Ads During Active Motion Cues

MotionFlow is designed to avoid intentionally interrupting an active ride experience with full-screen advertising while system-wide motion cues are actively running.

Advertising behavior may change between App versions, but privacy and safety considerations remain part of the App's design.

11. Internet and Network Access

MotionFlow may use internet access for functions such as:

• Advertising

• Analytics

• Opening external links

• App-related notices

• Google Play services

• Other optional online functionality

Core motion cue calculations do not require Team EXCITING to transmit raw motion sensor data to its own servers.

12. Third-Party Services

MotionFlow may use or interact with third-party services including:

• Google Play services

• Google Activity Recognition

• Google Mobile Ads / AdMob

• Firebase / Google Analytics

• Google Play

• External social media links

• Team EXCITING web pages

These services may process information according to their own privacy policies.

Team EXCITING does not control the independent data practices of third-party providers.

13. External Links

MotionFlow may provide links to services such as:

• Instagram

• YouTube

• TikTok

• Telegram

• Team EXCITING websites

• Other Team EXCITING applications

Opening an external link causes your device to interact directly with the corresponding third-party service.

Their privacy policies and terms apply once you leave MotionFlow.

14. Data Retention

MotionFlow's retention practices are generally as follows:

Local preferences:
Stored until changed, reset, cleared, or the App is uninstalled, subject to operating system backup behavior.

Motion sensor data:
Used in real time for motion cue calculations and not intentionally retained by Team EXCITING as a historical dataset.

Vehicle activity state:
Used to support Auto Ride and not intentionally maintained by Team EXCITING as a route or travel-history database.

Analytics information:
Retained according to the policies and retention settings of the applicable analytics provider.

Advertising information:
Processed and retained according to the applicable advertising provider's policies.

15. Security

MotionFlow uses standard platform security mechanisms, including:

• Android application sandboxing

• Operating system permission controls

• Restricted overlay behavior

• Local application storage

• HTTPS where network communications require it

No electronic system can be guaranteed to be completely secure.

Team EXCITING takes reasonable steps to minimize the amount of information processed by the App.

16. Children's Privacy

MotionFlow is not specifically designed for children under the minimum digital consent age applicable in their jurisdiction.

Team EXCITING does not knowingly operate a system designed to collect personal information from children through MotionFlow.

17. Your Privacy Choices

You may control MotionFlow permissions through your device settings.

Depending on your device, you may:

• Disable Display Over Other Apps

• Disable Activity Recognition

• Disable notifications

• Disable Auto Ride

• Change App preferences

• Reset your Advertising ID

• Limit ad personalization

• Adjust Google privacy settings

• Clear MotionFlow's App data

• Uninstall the App

Revoking certain permissions may disable related features.

For example:

• Disabling overlay permission prevents system-wide motion cues

• Disabling Activity Recognition prevents automatic vehicle detection

• Disabling notifications may limit foreground ride notification functionality

18. GDPR Rights

If the General Data Protection Regulation (“GDPR”) applies to you, you may have rights regarding personal information processed by third-party providers, including rights relating to:

• Access

• Correction

• Erasure

• Restriction

• Objection

• Data portability

• Withdrawal of consent

Because Team EXCITING does not maintain proprietary user accounts or a proprietary database containing MotionFlow motion histories, Team EXCITING may not possess data that can be directly associated with an individual user.

For information processed independently by Google or other third parties, requests may need to be directed to the applicable service provider.

19. California Privacy Rights

Where the California Consumer Privacy Act or California Privacy Rights Act applies:

Team EXCITING does not sell personal information collected through MotionFlow.

Certain advertising or analytics providers may process information under their own privacy frameworks.

Where applicable, users may limit personalized advertising or related processing through device settings, consent controls, or provider-specific privacy controls.

20. International Data Processing

Third-party providers such as Google may process technical, analytics, or advertising information in countries outside your country of residence.

Such transfers are governed by the provider's privacy practices and applicable legal safeguards.

Core MotionFlow sensor calculations are designed to occur locally on the user's device.

21. No Sale of Personal Information

Team EXCITING does not sell:

• Raw motion sensor data

• Vehicle activity history

• Precise location

• Screen contents

• User communications

• Personally identifying account information

MotionFlow does not maintain its own user profile database for advertising purposes.

22. Policy Updates

This Privacy Policy may be updated when:

• New features are introduced

• Permission requirements change

• Android behavior changes

• Third-party services change

• Legal requirements change

• Advertising or analytics functionality changes

The “Last Updated” date at the top of this document indicates the latest revision.

Material changes may be communicated within the App where appropriate.
