1. Acceptance of Terms

By downloading, installing, or using EVP Pro (the "App"), you are deemed to have agreed to be legally bound by these Terms of Service (the "Terms"). If you do not agree, please do not install or use the App. Continued use of the App after the Terms have been updated constitutes acceptance of the revised Terms.

2. Service Overview

EVP Pro is a sensor-based measurement and recording app designed for paranormal-themed investigation as entertainment. Using your device's built-in hardware — including the microphone, magnetometer, and accelerometer — the App measures real physical signals such as sound in the human voice frequency range, magnetic field strength, and micro-vibrations, and records detected anomalies in session logs. Features may be changed without prior notice.

3. Entertainment and Informational Purposes Only

All measurements displayed in the App are genuine, unmodified readings from your device's sensors. However, the App makes no claims whatsoever regarding the cause, origin, or meaning of any detected signal or anomaly. The App does not and cannot verify the existence of paranormal phenomena, and no content in the App should be understood as evidence of such phenomena. Interpretation of all data is entirely the responsibility of the user. The App is provided for entertainment purposes only. Measurement accuracy is limited by your device's hardware, and readings should not be relied upon as professional or scientific instrumentation. Team EXCITING assumes no responsibility for any decision made by the user based on the App's measurements or displays.

4. Sensor Data Processing

All sensor data — including microphone audio, magnetometer readings, and accelerometer readings — is processed locally on your device in real time. The App does not transmit sensor data, audio, or measurement results to any server operated by Team EXCITING or any third party. The App does not use any artificial intelligence or external processing services.

5. Data Collection and Privacy

(a) Data We Collect

The only data collected through the App is a device identifier used for serving in-app advertisements. This is processed by third-party advertising providers and is used solely for ad-serving functionality.

(b) Data We Do NOT Collect

EVP Pro does not collect, store, transmit, or share any of the following:

• Microphone audio, recordings, or any audio-derived data

• Sensor readings (magnetic field, vibration, or otherwise)

• Session logs or detection records

• Your location or GPS data

• Any personal information beyond the advertising device identifier

• Usage analytics, crash reports, or behavioral data (except for the minimum technical information necessary for normal operation and error handling of the App)

(c) Third-Party Advertising

The App displays advertisements served by third-party advertising providers. These providers may collect device identifiers for ad-targeting purposes in accordance with their own privacy policies. Team EXCITING is not in a position to control the data-handling practices of these advertising providers.

6. Local Data Storage

All data associated with the App — including session logs, detection records, and app settings — is stored only on your device. Team EXCITING has no means of accessing data stored locally on your device. Deleting the App may permanently remove local data, depending on your device's operating system and backup settings.

7. Prohibited Conduct

You agree to use the App in a lawful and appropriate manner. The following are prohibited:

• Reverse engineering, exploiting, or attempting to circumvent the App's systems

• Using the App while driving or in any situation requiring your full attention

• Using the App in dangerous, restricted, or unlawful locations; you are solely responsible for your physical safety and for complying with all applicable laws (including trespassing laws) during any investigation

• Using the App or its measurements as a substitute for professional, scientific, safety, or emergency services

• Using the App to record other persons' voices or conversations without their consent, or in violation of applicable recording and privacy laws

• Reproducing, distributing, or commercially reselling the App's content without authorization

8. Third-Party Services

The App may contain links to social media or external websites. Team EXCITING is not responsible for the content, privacy policies, or terms of service of any third-party services.

9. Intellectual Property

All intellectual property rights related to the App are owned by or licensed to Team EXCITING. These Terms grant you a limited, personal license to use the App for its intended purpose, and do not grant any further right, title, or interest.

10. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE," without warranties of any kind. To the maximum extent permitted by law, Team EXCITING disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, uninterrupted operation, and the accuracy of any sensor measurement or detection result.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Team EXCITING shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. This includes damages resulting from decisions made in reliance on the App's measurements, detections, or displays, and any injury or loss occurring during investigation activities conducted while using the App.

12. Indemnification

You agree to indemnify and hold harmless Team EXCITING and its affiliates from any claims, damages, or costs arising from your breach of these Terms, your misuse of the App, or the consequences of your use of the App.

13. Changes and Termination

Team EXCITING may change, suspend, or terminate the App or these Terms at any time without prior notice. Continued use after changes constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by applicable law. In the event of a dispute, the parties shall first attempt to resolve it through good-faith consultation.

15. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary or severed without affecting the remaining provisions. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Team EXCITING regarding the App.

1. Overview

EVP Pro (the "App") is a sensor-based measurement and recording app designed for paranormal-themed investigation as entertainment. Using your device's built-in hardware — the microphone, magnetometer, and accelerometer — the App measures real physical signals and records detected anomalies in session logs. This Privacy Policy explains what data is processed when you use the App, how it is used, and the choices available to you. EVP Pro is designed with privacy as a priority and processes only the minimum data necessary to operate the service.

2. Data We Do NOT Collect

Team EXCITING does not operate any server for collecting user data. The following data is never collected, stored, transmitted, or shared:

• Microphone audio, voice recordings, or any audio-derived data — all audio is analyzed in real time on your device only and is never transmitted anywhere

• Sensor readings (magnetic field, vibration, or any other measurement)

• Session logs or detection records

• Direct personal identifiers such as your real name, phone number, address, or email (the App does not ask for any of these)

• Location information or GPS data

• Contacts, SMS, call logs, or payment information

• Usage analytics, behavioral data, or crash reports

3. Data Stored Locally on Your Device

The following data is stored only on your device to provide App functionality:

• Session logs and detection records (timestamps, measured values, and detection grades)

• App settings and preferences (language, etc.)

All of this local data is managed by your device's operating system. Team EXCITING has no means of accessing this data at any time. Deleting the App may remove all local data, depending on your operating system's behavior and backup settings.

4. How Sensor Data Is Processed

All sensor data used by the App — microphone audio, magnetometer readings, and accelerometer readings — is processed locally on your device in real time, solely to display measurements and detect anomalies within the App.

Important: The App does not record, save, or transmit microphone audio. Audio captured by the microphone is analyzed on-device the moment it is received and is immediately discarded; only numerical measurement results (such as timestamps and signal levels) are kept in your local session logs. No sensor data of any kind ever leaves your device. The App does not use any artificial intelligence or external processing services.

5. Advertising and Device Identifiers

The App displays advertisements served by third-party advertising providers (such as Google AdMob). Solely for the purpose of serving ads, these providers may process your device's advertising ID (AAID on Android / IDFA on iOS) and basic device information. This is a separate data-processing activity that occurs in connection with the App.

Team EXCITING does not receive, access, or store your advertising ID or any advertising-related data on its own servers. All processing of advertising data is governed by the third-party advertising providers' privacy policies.

You can reset your advertising ID or opt out of personalized advertising at any time in your device settings:

• Android: Settings → Privacy → Ads

• iOS: Settings → Privacy & Security → Tracking

6. App Permissions

EVP Pro requests the following device permissions:

• Microphone: Required to measure sound levels and analyze audio frequencies in real time for the App's core detection feature. Audio is processed on-device only and is never recorded, stored, or transmitted.

• Internet: Required to serve advertisements.

EVP Pro does not request access to contacts, call logs, SMS, camera, location, or any other permission not listed above. Motion and magnetic field sensors (accelerometer and magnetometer) are accessed through standard system APIs that do not require separate user permission; their readings are likewise processed on-device only.

7. Third-Party Services and Links

The App may contain links to third-party platforms such as Instagram, YouTube, TikTok, and Telegram. When you use these links, your device connects directly to those services and their respective privacy policies apply. Team EXCITING is not responsible for the data practices of third parties.

8. Data Retention

• On-device data (session logs and settings): Retained until you delete individual records, reset the App, or uninstall the App

• Microphone audio: Not retained at all — analyzed in real time and immediately discarded; never stored or transmitted

• Advertising data: Subject to the retention policies of the third-party advertising providers

• Location data: The App does not collect location data of any kind

9. Security

EVP Pro relies on platform-level protections, including sandboxed app storage, operating-system permission management, and HTTPS encryption for any network requests (which are limited to ad serving). Because no user data is ever transmitted to Team EXCITING or any external service, privacy risks are minimized by design.

10. Children's Privacy

The App is not directed at children under the age of consent defined by applicable law. If you believe a child has used the App in a manner involving data transmission, please contact us at corp.exciting@gmail.com and we will take appropriate action after review.

11. Your Rights and Choices

You may at any time:

• Change the App's language and other settings within the App

• Delete individual session records within the App, or uninstall the App to remove all local data

• Reset or limit your advertising ID in your device settings

• Decline to use third-party links

• Deny or revoke the microphone permission in your device settings (the sound-detection feature will be unavailable, but other features will continue to work)

Team EXCITING does not store personal data on any server and therefore cannot act on deletion requests for data it does not hold. For data processed by third-party advertising providers, please refer to those providers' policies and opt-out procedures.

12. Legal Notices

Personal Information Protection Act (Republic of Korea): The App does not transmit any personal information to external parties. All measurement data is processed and stored exclusively on the user's device. The only data processing involving third parties is the advertising device identifier handled by advertising providers, as described in this Policy.

GDPR (EU/EEA): Team EXCITING does not process personal data on its own servers. Any GDPR-relevant data processing is limited to that performed by third-party advertising providers under their own compliance frameworks and consent mechanisms.

CCPA/CPRA (California): Team EXCITING does not sell personal information. You may opt out of personalized advertising at any time through your device's advertising ID settings.

State and Federal Recording Laws (United States): The App analyzes ambient audio in real time for measurement purposes and does not record or store audio. Nevertheless, you are solely responsible for complying with all applicable audio-monitoring and recording laws in your jurisdiction, including obtaining any required consent from persons present during your use of the App.

13. Updates to This Policy

This Privacy Policy may be updated to reflect feature changes, legal requirements, or changes in third-party policies. The "Last Updated" date indicates the most recent revision. Continued use of the App after an update constitutes acceptance of the revised Policy.
