These Terms of Service ("Terms") govern your download, installation, purchase, access to, and use of Finish 26.2 (the "App"), provided by Corp. Exciting ("Developer," "we," "us," or "our").
By using the App, you agree to these Terms and the Finish 26.2 Privacy Policy. If you do not agree, do not use the App or purchase a subscription. Nothing in these Terms limits any consumer right or remedy that cannot lawfully be waived.
If you are under the age of legal majority where you live, you may use the App only with permission from a parent or legal guardian. The App is not directed to children under 13.
Finish 26.2 is a virtual running and marathon-simulation utility. Depending on the App version, device capabilities, permissions, and access level, it may provide:
virtual running distances from short races to a full 42.195 km / 26.2-mile marathon;
city-themed visual stages and race atmosphere;
GPS- and motion-based distance, pace, timing, step, cadence, progress, and goal-pacer estimates;
race sound effects, optional crowd ambience, and haptic feedback;
Auto Pause, Screen Lock, background active-race tracking, and a visible foreground-service notification;
locally stored race history and rule-based on-device coaching summaries; and
result summaries and user-initiated sharing of a virtual race certificate.
Features may differ by platform, device, country, App version, permission status, and free or premium access. The purchase screen identifies the paid benefits available at the time of purchase.
Version 1.0.0 does not provide live or spoken coaching. Any Personal Race Coach feedback is text-only, generated on the device after a session from predetermined rules, and should not be understood as real-time coaching.
City names, images, stages, sounds, and descriptions are used to create a virtual atmosphere. They are not maps, turn-by-turn directions, certified courses, official race routes, or representations of your actual surroundings.
Finish 26.2 is independent and is not sponsored, endorsed, administered by, or affiliated with any city government, marathon organizer, race event, sports federation, tourism authority, or venue unless expressly stated. Third-party names and marks remain the property of their respective owners.
The App may use precise device location and motion or physical-activity sensors during a race to calculate distance, pace, steps, cadence, movement, progress, and related estimates. An active race may continue while the screen is off or the App is minimized through an operating-system foreground service and visible notification, where supported and permitted.
Location and sensor readings can be delayed, unavailable, or inaccurate because of satellite visibility, buildings, tunnels, weather, device hardware, phone placement, battery-saving settings, permissions, signal interference, operating-system restrictions, or other conditions. The App does not guarantee official race-grade measurement, timing, step counting, pace, finish time, or certificate accuracy. Do not use the App for certified results, navigation, emergency location, medical monitoring, or any purpose requiring guaranteed accuracy.
Your exact GPS coordinates are processed temporarily on your device for active-race calculations. The App does not create or retain a route history, and the Developer does not collect, receive, store, sell, share, or transmit exact GPS coordinates to a Developer server, advertising provider, subscription provider, analytics provider, or external API. Derived results may be stored locally as described in the Privacy Policy.
Running and walking involve risks, including falls, collisions, overexertion, dehydration, heat or cold illness, traffic incidents, and aggravation of existing conditions. You are responsible for deciding whether, where, and how to exercise.
You agree to:
consult an appropriately qualified professional before beginning or changing an exercise program when advisable for your health or circumstances;
select a lawful and reasonably safe route and remain aware of traffic, terrain, weather, people, animals, and other hazards;
obey local laws, property restrictions, event rules, and safety instructions;
avoid looking at or operating the device when doing so would be unsafe;
use audio at a level that allows you to remain aware of your surroundings; and
stop exercising and seek appropriate assistance if you experience chest pain, faintness, severe shortness of breath, unusual pain, confusion, or another concerning symptom.
Text-based pace, breathing, hydration, running-form, and recovery suggestions, estimates, and on-device coaching summaries are general informational and motivational features. They are not live or spoken coaching, medical advice, diagnosis, treatment, emergency assistance, or individualized professional coaching.
Some functions require location, physical activity, notifications, foreground-service access, audio, vibration, or other device capabilities. You control permissions through your device settings. Refusing or revoking a permission may prevent the related feature from working.
The App may not operate reliably if it is force-stopped, the device is powered off, required permissions are denied, background activity is restricted, battery optimization interrupts the foreground service, GPS is unavailable, or the operating system terminates the App. Test the App before relying on it for an important run.
Race history, settings, derived results, and active-session recovery information may be stored locally on your device. The Developer does not operate an account-based cloud race-history service for Version 1.0.0.
You may delete individual records or all local race data through available App controls. Clearing App data, uninstalling the App, losing or replacing the device, or changing backup settings may permanently remove local data. Operating-system or app-store backup and device-transfer services may separately retain or restore local App data according to your settings and their policies.
When you choose to share a certificate or result, the App uses the device's sharing interface. You decide which application, service, or person receives it. Once shared, the recipient or selected third-party service controls the shared copy under its own terms and privacy practices. The Developer does not automatically receive your shared result.
The free version may display advertising provided by third-party advertising services. Those services may process advertising identifiers, IP address, device and App information, consent choices, ad interactions, approximate location inferred from IP address, and related technical data under their own policies.
The App does not provide your exact GPS coordinates, route history, locally stored race history, pace, steps, cadence, or finish results to advertising providers for advertising or analytics.
An active premium entitlement may remove ads displayed by the App. This does not control content or promotions displayed by the operating system, app store, linked websites, or services outside the App.
Finish 26.2 Premium is an optional paid subscription. While the entitlement is active, it provides only the benefits displayed on the purchase screen at the time of purchase. Benefits may include ad removal and access to additional courses, distances, content, or features.
We may improve, replace, or reorganize features, but we will not intentionally misrepresent the material paid benefits currently offered. Technical, safety, legal, device, or app-store restrictions may still apply to premium users.
The applicable app store displays the price, currency, taxes, billing period, introductory offer or trial, and renewal terms before you confirm payment. Those displayed terms control over any outdated screenshot, advertisement, or example.
Unless clearly stated otherwise before purchase, subscriptions renew automatically at the end of each billing period. Your app-store account is charged according to the terms you confirm.
You may manage or cancel a subscription through the app-store account used to purchase it. Cancellation stops future renewal but ordinarily does not end access already paid for; access generally continues until the displayed expiration date. Deleting the App does not cancel a subscription.
Premium access may end sooner if the purchase is refunded and revoked, charged back, canceled because of payment failure, found invalid, or otherwise terminated under app-store rules. Subscription status may require an internet connection and a short processing period to synchronize among the app store, subscription-management provider, and App.
Purchases are processed by the applicable app store. Refund eligibility and timing are governed by that store's policy and applicable law. Except where required by law, cancellation alone does not create a right to a prorated refund.
The App may offer purchase restoration. Restoration generally requires the same platform and app-store account used for the original purchase. Expired, refunded, revoked, charged-back, or unverifiable purchases cannot provide premium access.
You must not:
use the App unlawfully or in a manner that endangers yourself or others;
manipulate GPS, sensors, purchases, entitlements, results, certificates, or App operation for fraud or misrepresentation;
bypass access controls, advertising controls, security measures, or usage restrictions;
reverse engineer, decompile, modify, distribute, resell, sublicense, or exploit the App except where applicable law expressly permits;
introduce malicious code, interfere with the App or third-party services, or attempt unauthorized access; or
use App branding or generated certificates to falsely claim an official, certified, or event-sanctioned result.
We may restrict functionality where reasonably necessary to address fraud, security threats, legal requirements, app-store requirements, payment revocation, or a material breach of these Terms.
The App's software, interface, design, branding, artwork, audio, text, and Developer-created materials are owned by or licensed to Corp. Exciting and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the App for its intended purpose.
No ownership right in the App or its content is transferred to you. You retain rights in content you independently create. A result certificate is provided for personal sharing and does not establish an officially verified athletic achievement.
The App may rely on Google Play, Apple App Store where available, Google AdMob, Adapty, operating-system services, mapping or location frameworks operating on the device, and user-selected sharing services. Third-party services operate under their own terms and privacy policies and may be unavailable, changed, or restricted independently of us.
References to third-party services do not imply endorsement. To the extent permitted by law, we are not responsible for third-party acts, outages, policies, or content. This section does not exclude any responsibility that cannot legally be excluded.
The App is provided on an "as is" and "as available" basis. We may update, repair, replace, suspend, or discontinue features to improve the App, address security or legal requirements, maintain compatibility, or respond to third-party changes.
We do not guarantee that the App will always be available, error-free, uninterrupted, compatible with every device, or capable of recovering every local record. Updates may be required to continue using some features.
To the maximum extent permitted by law, we disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, availability, safety, and uninterrupted operation.
We do not warrant that any GPS measurement, pace, time, step count, cadence, goal estimate, coaching statement, course stage, certificate, or other result is accurate, complete, safe to rely on, or accepted by any event or organization. Some jurisdictions do not allow certain warranty exclusions, so part of this section may not apply to you.
To the maximum extent permitted by applicable law, Corp. Exciting and its personnel, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, opportunity, goodwill, or device functionality arising from or related to the App.
Where liability cannot be excluded, our aggregate liability arising from the App will not exceed the greater of: (a) the amount you paid for the App or Finish 26.2 Premium during the 12 months before the event giving rise to the claim; or (b) USD $10. This limitation does not apply to fraud, willful misconduct, gross negligence where non-waivable, personal injury caused by liability that cannot lawfully be limited, or any other liability protected by mandatory law.
To the extent permitted by applicable law, you agree to be responsible for reasonable claims, losses, and costs arising from your unlawful misuse of the App, violation of these Terms, infringement of another person's rights, or fraudulent use of results or certificates. This section does not apply where prohibited by consumer law.
You may stop using the App at any time. Uninstalling the App does not cancel a subscription. We may suspend or terminate access where reasonably necessary because of unlawful activity, serious or repeated violations, payment revocation, security threats, app-store requirements, or risk to users or the service.
Sections that by their nature should survive termination—including ownership, disclaimers, liability limitations, and dispute provisions—remain effective to the extent permitted by law.
We may update these Terms to reflect changes in the App, subscriptions, law, safety practices, or third-party requirements. The revised Terms will display a new effective date. Where required, we will provide additional notice or request consent.
Continued use after updated Terms take effect constitutes acceptance to the extent permitted by law. If you disagree with an update, stop using the App and separately cancel any active subscription through the applicable app store.
These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law principles. This choice does not deprive consumers of mandatory protections available under the laws of their place of residence.
Any dispute will be submitted to a court having jurisdiction under applicable law. Before filing a claim, you are encouraged to contact us so we can attempt to resolve the matter informally.
If any provision is found invalid or unenforceable, the remaining provisions remain effective, and the affected provision will be enforced to the maximum lawful extent. Failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent, except where applicable law provides otherwise.
These Terms, the Privacy Policy, and the purchase terms shown by the applicable app store constitute the agreement concerning your use of the App.

This Privacy Policy explains how Corp. Exciting ("Developer," "we," "us," or "our") handles information in connection with Finish 26.2 (the "App").
Finish 26.2 is designed around local processing and data minimization:
no Finish 26.2 account, registration, or login is required;
exact GPS coordinates are processed temporarily on the device only during an active race;
the App does not save exact GPS coordinates or route history;
the App does not send exact GPS coordinates, route history, or locally stored race results to the Developer, an external API, an advertising provider, or a subscription provider;
derived race results and preferences are generally stored locally on the device; and
third-party advertising and subscription services may separately process limited technical, advertising, consent, and purchase information as described below.
This Policy applies to the App's location and motion processing, local race records, advertising, subscription verification, purchase restoration, user-initiated sharing, and support communications.
It does not control Apple, Google, Adapty, a user-selected sharing destination, linked websites, device backup services, or other third parties. Those services process information under their own privacy policies.
When you explicitly start a race and grant location permission, the App may access precise GPS readings such as latitude, longitude, timestamp, speed, direction, and accuracy information supplied by the device. These readings are necessary to calculate distance, pace, movement, race progress, and Auto Pause behavior.
Where supported, an active race may continue while the screen is off or the App is minimized through an operating-system foreground service and visible notification. Location processing stops when the race ends or is terminated, subject to brief operating-system and cleanup processing.
Exact GPS readings are processed temporarily in device memory for active-race calculations. Finish 26.2 does not:
upload exact GPS coordinates to a Developer server;
send exact GPS coordinates to an external API;
provide exact GPS coordinates to Google AdMob, Adapty, analytics services, or other third parties;
save exact GPS coordinates in the App's local race history;
create or retain a route map or route history;
use precise GPS location for advertising, profiling, or sale; or
access location when no active race requires it.
Only derived values—such as total distance, elapsed time, moving time, average pace, steps, cadence, selected virtual course, selected goal, completion status, and related race statistics—may be stored locally. These derived records do not contain exact GPS coordinates or a reconstructable route history.
You can deny or revoke location permission through device settings. Without required location access, distance, pace, progress, Auto Pause, and related features may be unavailable or inaccurate. Device and operating-system settings may show location access associated with a foreground service while an active race continues in the background.
With permission where required, the App may access step counts, accelerometer, gyroscope, movement, and related physical-activity or device-sensor signals. The App uses these signals on the device to support step counting, cadence, movement detection, race calculations, haptic features, and rule-based coaching summaries.
The App does not send raw motion readings, step history, cadence, pace, race results, or coaching inputs to the Developer, AdMob, Adapty, or an external API. Derived race statistics may be saved locally as described below.
Finish 26.2 does not connect to Health Connect, Google Fit, Apple Health, or another health-record platform in Version 1.0.0 unless an updated App interface and Policy expressly disclose that functionality.
The App may store the following in operating-system-protected App storage:

Review or milestone state
Avoid repeatedly showing the same optional prompt
Local race records do not contain exact GPS coordinates or route history. The Developer does not operate an account-based cloud race-history service for Version 1.0.0 and does not have routine access to these local records.
You can delete individual records or erase all local race data through available App controls. Clearing App data or uninstalling the App generally removes local App storage. However, operating-system, app-store backup, or device-transfer services may retain or restore copies according to your settings and their policies.
Finish 26.2 does not require you to provide the following to run or save a race:
name, email address, phone number, or postal address;
a Finish 26.2 account or password;
contacts or address book;
photos, videos, microphone recordings, or personal files;
government identification numbers;
payment-card details; or
medical records or diagnoses.
Payment details are handled by the applicable app store. We do not receive or store full credit- or debit-card numbers.
If you contact us, we receive your email address and any information you voluntarily include. Do not send sensitive health, financial, identity, or precise-location information unless it is necessary for your request.
The free version may display ads through Google AdMob and related Google consent services. Depending on your device, region, consent choice, platform settings, and ad type, Google may process:
IP address;
advertising ID, App Set ID, or similar device or app identifiers;
device model, operating system, language, App version, and general technical information;
ad views, clicks, interactions, frequency, and delivery information;
approximate location inferred from IP address;
diagnostics, performance, and fraud-prevention signals; and
consent choices and privacy settings.
This data may be used to deliver, measure, limit, personalize, secure, and improve advertising as permitted by your consent choices and applicable law. Non-personalized or limited ads may still require IP address and technical information for delivery, security, fraud prevention, or frequency control.
Finish 26.2 does not provide Google AdMob with exact GPS coordinates, route history, locally stored race history, distance, pace, steps, cadence, goals, finish status, or coaching summaries.
An active premium entitlement may stop the App from requesting ads. Previously processed advertising data remains subject to Google's retention practices. You can manage available choices through the consent interface, device advertising settings, Google settings, or other controls required in your region.
We do not sell personal information for money. In some jurisdictions, personalized or cross-context behavioral advertising may legally be considered a "sale," "sharing," or targeted advertising. Where required, consent or opt-out choices will be made available through the App, device, platform, or advertising provider.
Purchases are processed by Google Play or Apple App Store where available. The App may use Adapty to retrieve products and paywalls, verify purchases, restore eligible purchases, prevent entitlement fraud, and determine whether Finish 26.2 Premium is active.
The app store and Adapty may process:
product and base-plan identifiers;
transaction identifiers, receipts, or purchase tokens;
subscription status, renewal, expiration, cancellation, refund, revocation, grace-period, and billing-issue information;
app-store country, currency, and localized price;
a pseudonymous App-user, installation, or Adapty profile identifier;
platform, App version, device information, IP address, and related technical information; and
paywall views, purchase events, and restoration events.
This information is used to complete purchases, show the correct entitlement, restore access, prevent fraud, troubleshoot billing, and meet accounting, consumer-protection, or legal obligations. The Developer does not receive full payment-card details.
Adapty and the app store do not receive exact GPS coordinates, route history, or locally stored race results from Finish 26.2. Deleting the App does not cancel a subscription; subscription management is handled through the app-store account used for purchase.
If you choose to share a race result or virtual certificate, the App prepares the content on your device and opens the operating system's sharing interface. You choose the recipient or third-party application.
The Developer does not automatically receive the shared content. The selected recipient, social network, messaging service, cloud service, or other destination may collect, retain, display, or redistribute the content under its own terms and privacy policy. Review the content and destination before sharing.
Finish 26.2 does not operate a Developer server that receives race or precise-location data. Third-party advertising, subscription, app-store, network, and operating-system services may nevertheless process ordinary connection and technical information when their features are used, including IP address, timestamps, request status, SDK or App version, device type, security events, and error information.
If you contact support, we process your email address, message, attachments, and related correspondence to answer your request, troubleshoot problems, protect rights, and maintain appropriate support records.
Where applicable law requires a legal basis, information is processed on one or more of the following grounds:
Performance of a contract: providing requested App functions, verifying purchases, restoring entitlements, and remembering settings;
Consent: precise-location permission, physical-activity permission, personalized advertising, or other processing where consent is required;
Legitimate interests: maintaining security and reliability, preventing fraud, diagnosing errors, protecting the App, and providing contextual advertising where permitted;
Legal obligations: accounting, tax, consumer protection, lawful requests, and regulatory compliance; and
Protection of rights and safety: investigating misuse, enforcing applicable terms, and protecting users, the Developer, and service providers.
You may withdraw consent through available App, device, or platform controls. Withdrawal does not affect processing already lawfully completed and may prevent the related feature from operating.

Providers may use subprocessors and operate in multiple countries. Their independent processing is governed by their policies and applicable contractual or legal requirements.

Because there is no Finish 26.2 account or Developer-operated cloud race database, deleting local App data generally cannot instruct independent app stores, advertising services, subscription providers, backup providers, or sharing destinations to delete information they control. You may need to contact those providers directly.
Corp. Exciting is based in the Republic of Korea. Google, Apple, Adapty, and their subprocessors may process technical, advertising, consent, or purchase information in the Republic of Korea, United States, European Economic Area, or other countries where they operate.
These countries may have privacy laws different from those where you live. Where required, the relevant controller or processor relies on recognized transfer mechanisms or other lawful safeguards. Exact GPS coordinates and locally stored race history are not transferred internationally by Finish 26.2 because the App does not transmit them off the device.
We use safeguards appropriate to the App's architecture, including:
on-device processing of precise GPS and raw motion readings;
no Developer-operated cloud account or race-history database;
operating-system-protected local App storage;
encrypted network connections used by third-party advertising, app-store, and subscription services where supported;
permission-based access to precise location and physical activity; and
data minimization that separates local race information from advertising and subscription services.
No device, storage method, transmission, or third-party system is completely secure. We cannot guarantee absolute security or recovery of local data. Protect your device and app-store account and install operating-system and App updates when available.
You can:
start and end location processing by controlling active races;
deny or revoke location, physical-activity, or notification permissions in device settings;
delete individual race records or all local race data through available App controls;
clear App data or uninstall the App, subject to platform backup and subscription rules;
manage consent and advertising choices through available App, Google, Apple, or device controls;
manage or cancel subscriptions through the applicable app store;
choose whether and where to share a result or certificate; and
contact us about privacy questions or applicable legal rights.
Depending on where you live and subject to legal exceptions, you may have rights to access, correct, delete, restrict, or port personal information; object to processing; withdraw consent; opt out of certain targeted advertising, sale, or sharing; and lodge a complaint with a data-protection authority.
Because the App requires no account and the Developer does not receive exact GPS coordinates or local race history, we generally cannot identify or retrieve that on-device data. Delete it directly through the App or device. We may request reasonable verification before acting on a request involving support correspondence or pseudonymous provider records.
Finish 26.2 is a general-audience fitness utility and is not directed to children under 13. We do not knowingly request a child's name, contact details, exact location, or race history.
If you are under the age of legal majority where you live, use the App only with permission and supervision from a parent or legal guardian. If we learn that personal information from a child was provided to us in violation of applicable law, we will take reasonable steps to delete it, subject to the information available to us and any legal obligation to retain it.
The Personal Race Coach uses predetermined rules on the device to generate text-only feedback from locally available race statistics after a session. Version 1.0.0 does not provide live or spoken coaching. The Personal Race Coach does not use artificial intelligence, send coaching inputs to a server, create a user profile for advertising, or make legal or similarly significant decisions about you.
This Policy, the App's permission disclosures, Google Play Data Safety section, Apple App Privacy information where applicable, and consent flow should be consistent and read together. Store disclosures must also reflect the actual versions and configuration of third-party SDKs included in the released App.
If the App's features, permissions, SDKs, or data flows change, we may update this Policy and the relevant store declarations.
We may update this Policy to reflect changes in App features, providers, law, security practices, or data handling. The updated Policy will display a revised effective date and version. Where required by law, we will provide additional notice or obtain consent.
The updated Policy applies to subsequent use from its effective date, except where applicable law requires another form of agreement.
