SID TRUSTEE'S ELECTION NOTICE

NOTICE OF ELECTION

YOU ARE HEREBY NOTIFIED that an election of the Board of Trustees for Sanitary and Improvement District No. 1 of Gosper County (and Dawson County), Nebraska, shall be held by mail-in ballots sent to all qualified voters (as defined by Nebraska Statute Sec. 31-735) by the Election Commissioner of Gosper County, Nebraska, on or before August 22, 2012 along with instructions to the voter and a return envelope. The ballots must be returned to the Election Commissioner of Gosper County by 4:30 p.m. on September 11, 2012.

The deadline for filing an application to be on the ballot for Trustee is 4:30 p.m. on July 23, 2012. Applications to be on the ballot may be obtained from the Election Commissioner's Office located in the Gosper County Courthouse at 507 Smith Avenue, Elwood, Nebraska, and must be acknowledged before a Notary Public or the Election Commissioner, and filed with the Gosper County Election Commissioner. Such trustees shall be fee simple owners of real estate located in the District or a designated representative of a limited partnership, general partnership, limited liability company, public, private or municipal corporation, estate, or trust which owns real estate in the district. In the case of a designated representative, the filing shall indicate that fact and shall include appropriate documentation evidencing such fact. Such documentation shall be a certificate of authentication duly executed by the appropriate individual for that entity (e.g. the secretary for a corporation, the managing member of an LLC, etc.). No filing fee is required. Write-in candidates may also be elected. A write-in candidate who will serve as a designated representative of a limited partnership, general partnership, limited liability company, public, private or municipal corporation, estate, or trust which owns real estate in the district shall not be elected to the office of trustee unless (a) each vote is accompanied by the name of the entity which the candidate will represent and (b) within ten days after the date of the election the candidate provides the election commissioner with appropriate documentation evidencing his or her representation of the entity. Votes cast which do not carry such accompanying designation shall not be counted.

The total number of trustees to be elected shall be five (5). Three of the Trustees shall be elected by the legal property owners (as defined by Nebraska statutes) resident in the District, and the remaining two Trustees shall be elected by all of the owners of real estate located within the District. For each platted lot or acre of unplatted land or fraction thereof which he or she may own in the District, each resident legal property owner (as defined by Nebraska statutes) may cast one vote for each of the three offices of trustee such owners are entitled to elect, and each resident and non-resident legal property owner may cast one vote for each of the two remaining Trustees to be elected. The name of each candidate shall appear on only one ballot.

For purposes of voting for trustees, fee simple owners are entitled to vote unless a lot or parcel is leased under a lease for an initial term of not less than twenty years and the lessee is required to pay taxes and special assessments levied on the leased property, in which case the lessee shall be entitled to cast the vote of such property. In addition, because more than fifty percent of the homes/cabins are used as a second, seasonal, or recreational residence, such owners or long term lessees of such property shall be considered legal property owners resident within the district for purposes of electing trustees.

When a lot or unplatted land in the District is owned jointly, only one person shall be entitled to cast the vote of such property.
