2 sewer lawsuits dismissed

LEXINGTON, Neb. - Two lawsuits challenging fees assessed by the Johnson Lake Sewer Improvement District have been dismissed.

Dawson County District Judge James E. Doyle signed an order Friday dismissing a long-standing lawsuit brought by several property owners.

The dismissal was filed at the request of Lincoln attorney Terry Barber on behalf of himself and other property owners who have cabins or homes on the east side of the lake.

The group represented by Barber was the remnant of a protest initiated immediately after Doyle approved the establishment of the sewer district in 2003.

In addition to Barber, Karen Brown, Connie Joy Van Wie, Ralph and Lois Niemoth, Glen and Teresa J. Lanman, Gary R. Neff and Douglas and LuAnn Everson were the plaintiffs.

Their appeal of the levies was to be heard Tuesday.

The second dismissed lawsuit had been brought by the Nebraska Game and Parks Commission. A request for dismissal of the suit was filed by Assistant Nebraska Attorney General Jody Gittins.

The Games and Parks lawsuit's dismissal was requested March 18 and was granted March 22. The case had been scheduled for trial on June 3.

No reason was given for either action.
