SID ELECTION NOTICE

Post date: Jul 10, 2010 5:40:41 PM

Notice of the upcoming election for the Board of Trustees for our Johnson Lake SID was mailed yesterday to all owners and lessees of property at J-Lake. A copy of the notice is attached below and the two most common questions are answered below. State statutes requires the use of two ballots for the election held four years after the first election, as explained below. Two important dates are:

July 26th – Filing deadline for candidates by 4:30 p.m. at Gosper Co. Clerk's Office

September 14th Election Day -- All Ballots Due in Gosper Co. Election Office by 4:30 p.m.

WHO CAN SERVE AS A TRUSTEE?

An owner of deeded property (real estate fee simple); OR, an individual who is a designated representative of a legal entity (limited partnership, general partnership, LLC, public, private or municipal corporation, estate or trust) that owns real estate within the SID boundary; providing the appropriate documentation evidencing such fact has been filed with the Gosper County Clerk/Election commissioner. Each candidate must choose to run on either the “Resident” Ballot (2 to be elected) or the “Resident and Non-resident” Ballot (3 to be elected).

WHO CAN VOTE??

All owners of fee simple deeded property and long term (20 yrs or more) leaseholders.

Because of the unique circumstances at Johnson Lake in that over 50% of the homes are used as second, seasonal or recreational residence, ALL voters (owners or long term lessees) with homes will be considered RESIDENT voters, and therefore be eligible to vote for ALL trustee candidates on both the “Resident” Ballot and the “Resident and Non-resident” Ballot. Long term leaseholders of Central's residential lots are considered eligible voters because the lease is for a period of greater than 20 years and requires the lessee to pay taxes and special assessments levied on the leased property. The lessee or the owner of the lessee's interest will cast the vote for that lot for which they hold the long term lease. Only one person shall cast the vote for each plotted lot or each acre of unplotted property within the District. Those only owning a bare unimproved lot and not owning a home at Johnson Lake within the SID boundary will only be eligible to vote for trustee candidates on the “Resident and Non-resident” Ballot.
