ASSESSMENT PAYMENTS for Johnson Lake SID#1:--

PAYMENTS ARE NOW DUE AND SHOULD BE PAID TO YOUR COUNTY TREASURER

Interest Rate = 5% Delinquent Rate = 7%

Levy Date August 12th 2009; thus August 12th becomes the annual due date and date of delinquency; thus any annual payment then due and paid after August 12th will bear delinquent interest at 5% on the full balance due and 2% penalty on the current principal amount due from the August 12th (date of delinquency) until such time that the delinquent annual payment is paid in full.

If three or more installments are delinquent, the board may declare the remaining installments to be at once delinquent; after which they will accrue interest at the rate set by State Statute section 45-104.1; which is currently 14%.

Assessments are by law, an automatic lien on the property, collectable 2nd to general taxes levied; and will be included on the county's tax sale listings and can then be foreclosed upon as described in State Statutes section 77-1917.01 provided in part below; which provides a complete remedy for the foreclosure of special assessment liens.

Authorizing statutes:

31-753 Special assessments; installment payment; interest; delinquent; collection.

… Such assessments shall become delinquent in equal annual installments over such periods of years, not exceeding twenty, as the board of trustees or the administrator may determine at the time of making the levy. Delinquent installments shall bear interest at the rate of two percent per annum above the rate set by the district on such installments before delinquency, …

...If three or more installments shall be delinquent, the board of trustees or the administrator may declare all of the remaining installments to be at once delinquent...

77-1917.01 Delinquent special assessments; effect; foreclosure proceedings:

All cities, villages and sanitary and improvement districts in Nebraska shall have a lien upon real estate within their boundaries for all special assessments due thereon to the municipal corporation or district...

When such special assessments have become delinquent, ...the district involved may itself as party plaintiff proceed to the district court of the county in which the real estate is situated to foreclose, in its own name, the lien for such delinquent special assessments in the same manner and with like effect as in the foreclosure of a real estate mortgage....

The remedy granted in this section to cities, villages and sanitary and improvement districts for the collection of delinquent special assessments shall be cumulative and in addition to other existing methods.
