Background Checks for New Hires

The HireForms process initiates the workflow for HR to begin a BCI background check, so management does NOT need to make a separate request to HR for a background check to be conducted, nor does management need to collect personal information from new hires for background check purposes.

Note: the above does not apply to interns or externs, nor to any other hire made outside of the ApplicantPro / HireForms system. More information can be found on this Intranet Page (accessible only through VPN or onsite).

BCI Background Check Results

Job offers should be made contingent upon the successful completion of a background check through the Utah Bureau of Criminal Investigation (BCI).

HR facilitates the background check and will communicate the results of the check with the hiring official - any "hits" will only be communicated verbally. The hiring official may then make a final hiring decision consistent with policy HR04-15 governing background checks.

Hiring Manager Decision

If the hiring official determines not to hire a candidate due to results of a background check, the hiring official may consider the following suggested messaging of their decision to the job candidate:

"Consistent with the information in your offer letter regarding the contingency to successfully complete a background check, I have reviewed the results of your background check with our HR Department and the policy governing my authority to make a hiring decision found in HR04-15. Based on the information in your background check, it is my decision to rescind the offer of employment with the Utah State Courts. Consistent with the requirements found in Utah's Public Safety Code (UCA §53-10-108) and with the requirements of the agreement the Utah State Courts holds with BCI that background check records for employment screening purposes must not be saved or stored by the Courts, you may contact BCI directly if you have any questions or concerns about the information in your background check by following this link or contacting them directly at 801-965-4445."
