Ending Your Employment
If you are preparing to leave employment with the Judiciary, this information will help guide you through the process, whether you are resigning or retiring. Please keep in mind that this is a helpful resource provided by the HR Department. Your district may have additional steps or processes you must follow as well. Please check with your supervisor and HR team to see if they have any internal forms or processes.
If you are not retiring from state employment, to learn more about what leave types are eligible for payout at separation, please see below.
Important note: Terminating employees will not have access to view pay statements or W2 information in ESS or their state email account after last day worked.
Benefits End Date
An eligible employee's benefits will end according to their hire date.
If hired before February 15, 2003, benefits will end at 11:59 p.m. on the same day the individual receives their final check.
If hired after February 15, 2003, benefits end at 11:59 p.m. on the last day of the pay period in which they worked.
Retirement
The Courts HR Department processes all retirements for Court employees. If you are interested in retiring, you will need to start the process at least three months prior to your expected retirement date. Please review the information and resources on the retirement page.
Resignation
If you are resigning from employment with the Courts, here are some helpful reminders:
Notify both your supervisor and the HR Department (courtsHR@utcourts.gov) in person, via email, or by letter. If you are transferring to another state agency and into a benefit-eligible position, please notify HR to ensure benefits, direct deposit, applicable leave balances, and W-4 withholdings are transferred with you so long as there are no breaks in service.
Confirm your mailing address with HR, PEHP, and URS and update if necessary.
Contact PEHP at (801) 366-7555 to coordinate COBRA benefits, if applicable.
Contact URS at (801) 366-7770 for 401k/457 accounts information.
Contact any voluntary benefits providers for options (if any) for post-employment continuation.
Return any state-issued equipment, such as laptops, purchasing cards, ID badges, office equipment, UTA Transit passes, etc.
Enter your time before you leave on your last day.
Leave Payout at Separation
When an employee separates from state employment, eligible leave is paid as follows:
Annual / Excess / Comp Leave—An employee will be paid a lump sum for all annual leave and excess hours at their current hourly rate. An FLSA nonexempt employee shall also be paid a lump sum for all compensatory hours.
Converted Sick Leave—An employee separating from state service for reasons other than retirement will be paid a lump sum at their current hourly rate for all converted sick leave.
Sick Leave—Unless retiring, an employee separating from state employment shall forfeit any unused sick leave without compensation.
Accural or use of leave after LDW—Annual, sick, and holiday leave may not be used or accrued after the last day worked.
Rehired within one year—An employee rehired into a benefit-eligible position within one year of separation for reasons other than reduction in force shall have forfeited sick leave reinstated as Program III sick leave.

Exit Survey
Employees leaving the Courts are encouraged to complete this exit survey before, or at least on, their last day worked. Management and/or Administrative Assistants are encouraged to send this form to be completed for terminating employees other than employees being terminated for cause or employees in time-limited positions. Data from exit surveys are helpful for management to be aware of trends and consider improvements to retain staff. You can submit your responses confidentially to HR right here using this form.
