Sole Source/Sole Brand

A sole source procurement is justified when there is only one product or service that can reasonably meet the need and there is only one vendor who can provide the product or service. When there is only one brand that will meet the need, all vendors who supply the item/service will be considered potential bidders. The following are examples of circumstances that could justify a sole source procurement:

  • Where the compatibility of equipment, accessories, or replacement parts is the paramount consideration;

  • Where a sole supplier’s item is needed for trial use or testing;

  • Where public utility services are to be procured.

A Sole Source/Sole Brand Form must be submitted, with justification, to the DNR Purchasing staff for approval prior to the purchase.
