7(k) Information
7(k) Employees are those employees engaged in law enforcement activities who are classified as partially exempt from overtime requirements under Section 7(k) of the FLSA (DNR-111 FLSA Policy). These employees’ work period consists of up to 28 consecutive days. 7(k) employees are entitled to overtime for hours worked beyond 171 hours in a 28-day period.
7(k) Status
Park Manager I (Trainee) and II are 7(k) year round Non-Exempt (eligible for overtime).
Park Manager Ill and above are Exempt (not eligible for overtime).
Wildlife Manager I (Trainee) are 7(k) Non-Exempt.
Wildlife Manager II and Ill's are Exempt with the exception of two 28 day periods which ll's and Ill's are placed in a 7(k) Status.
During those periods, hours worked over 171 earns over time (or comp time if elected).
Note: When listed on the State Patrol's official On Call List during these timeframes, these employees need to enter the On Call Pay Code into Kronos. During their 7(k) periods is the only time they are eligible for using the On Call Pay Code.
Wildlife Managers IV, V and VI are Exempt year round.
Criminal Investigator IIs are 7(k) year round Non-Exempt.
