ANDHRA PRADESH - A CASE STUDY ON THE IMPACT OF RESERVATION IMPLEMENTED IN AP ON THE EDUCATIONAL PROGRESS OF BACKWARD CLASSES

The Government has always been sympathetic to the plight of the Backward Classes. They have strived to better their lot by various means. Government of Andhra Pradesh have appointed a Commission in April, 1968 vide G.O.Ms.No.870, Edn. Dated 12-4-1968, under the Commissions of Inquiry Act 1952 with the following terms of reference. i. to determine the criteria to be adopted in considering whether any sections of citizens of India in the State of Andhra Pradesh (other than SCs & STs) may be treated as Social and Educationally Backward Classes and in-accordance with such criteria prepare a list of such Backward Classes setting out also their approximate number and their territorial distribution. ii. to investigate the conditions of all such socially and educationally Backward Classes, and the difficulties under which they labor, and make recommendations as to the special provisions which may be made by the Government for their advancement and for promotion of their education and economic interest, generally and with particular reference to - 1) the reservation of seats in Educational Institutions maintained by State or receiving aid out of state funds, 2) the concessions such as scholarships which may be given by way of assistance, 3) the percentage of promotion of such reservation the quantum of such assistance and the period during which such reservation of such assistance may be made or given; and Interim report of the oversight committee on the implementation of the new reservation policy in higher educational Institutions 330 [Annexure X] iii. to advise the Government as to the Backward Classes of citizens, which are not adequately represented in the services under the state and prepare a list of all such BCs and make recommendations. The Commission adopted the following criteria for determining the social and educational backwardness of citizens. 1. General poverty of the class or community as a whole. 2. Occupations pursued by the classes. 3. Caste in relation to Hindus and 4. Educational Backwardness. Basing on the recommendations of Anantharaman Commission, dated 23-9-1970 vide G.O.Ms.No.1793 Education Department have issued orders communicating the list of Social and Educationally Backward Classes, concessions with regard to reservations in Educational Institutions, Services etc. From time to time certain modifications have been made to the BCs list. At present, 93 communities have been included in the list of BCs. All these communities are divided in four groups and percentage of reservation provided is as follows:- Group Communities No. of communities % of Reservation Group A Aboriginal Tribes, Vimukthi Jaties. Nomadic, Semi Nomadic etc 38 7 Group B Vocational Groups 20 10 Group C SCs converted to Christianity 1 1 Group D Other Classes 34 7 BC Commission was appointed on 13.03.1997 to look into the inclusion of additional communities & revision of existing communities with Justice D. Subramanyam as Chairman & Other member. Vide G.O.Ms.No.23, BCW (C2) Dept., dated 31-5-2001 Government have extended the concessions for the BCs in respect of reservation of seats in Educational Institutions as well as reservations in services including the percentage of reservation of posts, age concession of 5 years for the purpose of recruitment for a further period of 10 years with effect from 1-6-2001. Consequent on the above position and on the notification of the constitution 93rd amendment Act, 2005 effecting the 104th amendment to the constitution in January 2006 the Government of India indicated its intention to provide reservation for students coming from the socially and educationally backward classes of citizens popularly known as “Other Backward Classes” (OBCs) in higher educational institutions. The Government of Andhra Pradesh has been implementing 25% reservation for backward classes in educational institutions and service and the present concessions have been extended up to 10 years from 01.06.2001, Vide G.O. Ms. No. 23 BCW (C2) Dept. dated 31.05.2001.
By G.O. Ms. No. 30, dated 25-8-1994 issued by the State of Andhra Pradesh, 14 new castes/categories have been added to the existing list of Backward Classes. It is not a litigation of new kind. It is an ongoing battle of some castes for inclusion as Backward Classes for the purpose of availment of benefits of reservation, be it education or employment. There was a Kalelkar Commission firstly constituted in the year 1953 by the President in exercise of powers under Art. 340 of the Constitution of India. Kalelkar Commission was not approved and that is the reason why the Mandal Commission was constituted in the year 1978. Meanwhile, the State of Andhra Pradesh has issued G.O. Ms, No. 1886, dated 21-6-1963 specifying 139 castes as socially and educationally backward. The said list was prepared for the purpose of selecting candidates in Medical Colleges and 25% of the seats were reserved for them. The validity of this list was challenged in a writ petition and the same was quashed by a learned single Judge of this Court in Sukdev v. Government of Andhra Pradesh, (1966) 1 Andh WR 294. Again in 1966, Government of Andhra Pradesh has prepared another list specifying 112 communities as Backward Classes by G.O. Ms. No. 1880, dated 29-7-1966. This was for both the reservations in education and Government employment.The same was assailed and a Division Bench of this Court in R. Sagar v. State of A.P., AIR 1968 Andh Pra 105 struck down the same. The same was upheld by the Supreme Court in State of A.P. v. Sagar, . On 12-4-1968, Government of Andhra Pradesh appointed another Commission by G.O. Ms. No. 870 to identify the Backward Classes and to prepare a list having regard to the social and economic backwardness. The same is referred to as Anantharaman's Commission. The said Commission prepred a list specifyng 93 clases as socially and educationally backward and recommended the reservation of 30% of the seats in professional colleges and Government employment. The said list was submitted to the Government on 20-6-1970. In the report, 93 classes mentioned above were sub-divided into four groups, namely, A, B, C and D and inter se division of seats among them. The said report was accepted by the Government and the result was G.O.Ms. No. 1793, dated 23-9-1970. The quota of reservation accepted was 25% as against recommendation of 30%. This was again subjected to challenge before this Court and this Court struck down the same as being contrary to the Judgment of the Supreme Court rendered in M.R. Balaji v. Slate of Mysore, . The matter was carried in appeal to the Supreme Court and the Supreme Court in State of A. P. v. Balaram, reversed the decision of this Court. While, the earlier G.O.Ms. No. 1886, dated 21-6-1963 and G.O.Ms. No. 1880, daed 29-7-1966 were struck down on the ground of lack of material data classifying persons as Backward Classes, Anantaraman Commission's report was upheld by the Supreme Court stating that there was enough data collected by the Commission.

ఉమ్మడి ఆంధ్రప్రదేశ్ రాష్ట్రంలో ఎస్.ఈ.బి.సి.ల జాబితా కోసం 1968 లో వెనుకబడిన వర్గాల కమిషన్ గా అనంతరామన్ కమిషన్ ఏర్పాటుతో ఎస్.ఈ.బి.సి. ల సంక్షేమం, వికాసానికి తొలి అడుగు పడింది. G.O. Ms. No, 1793, Education Department, Dated. 23-09-1970 ద్వారా, A, B, C, D అనే నాలుగు గ్రూపుల్లో 93 SEBC వెనుకబడిన తరగతుల కులాల జాబితా ఏర్పాటైంది. 1975 లో G.O.Ms.No.561, Employment and Social Welfare (A) Dept., 01-07-1975 ద్వారా సామాజికసంక్షేమ డైరెక్టరేట్ నుండి బిసీసంక్షేమ డైరెక్టరేట్ ఏర్పాటైంది. G.O.Ms.No.72, Gen. Admn. (AR & T DESK) Dept., 22-02-1994 తో 1994 లో సెక్రటేరియట్ స్థాయిలో బి.సి. సంక్షేమ డిపార్ట్ మెంట్ ఏర్పాటైంది.
వెనుకబడిన తరగతుల కమిషన్ ఏర్పాటు:
Act 20 of 1993 ఆధారంగా ఏ.పి. వెనుకబడిన తరగతుల కమిషన్ ఏర్పాటైంది. ఏ.పి. పునర్విభజనకు ముందు చివరి బి.సి. కమిషన్ గడువు 24-09-2011 న పూర్తయింది.
విద్య, ఉద్యోగాలలో రిజర్వేషన్ సౌకర్యం:
ఏ.పి. పునర్విభజన అనంతరం తెలంగాణా రాష్ట్రంలో వెనుకబడిన తరగతులలో, A, B, C, D, E గ్రూప్ లలో 113 కులాలు జాబితా అయినాయి.
విద్య, ఉద్యోగాలలో రిజర్వేషన్ సౌకర్యం మొత్తం 29%. అంటే, బి.సి.(ఏ)-7%(42)(ఆదిమ తెగలు, విముక్తజాతులు, సంచార మరియు అర్ధసంచార తెగలు), బి.సి.(బి)-10%(25)(వృత్తిపరమైన
గ్రూపులు), బి.సి.(సి)-1%(1)(S.C.లు క్రిస్టియన్లుగా మార్పునొందినవారు), బి.సి.(డి)-7%(31)(ఇతర తరగతులు), బి.సి.(ఈ)- 4%(14) (ముస్లింలలో ఆర్ధికంగా,సామాజికంగా వెనుకబడినవారు), మొత్తం 113 కులాలు, 29%.

వెనుకబడిన తరగతులకు స్థానికసంస్థలలో 34% రిజర్వేషన్ సౌకర్యం ఉంది. విద్య, ఉద్యోగాలలో రిజర్వేషన్ వలె కాకుండా, స్థానికసంస్థలలో బీసీ
గ్రూపుల(ఏ,బి,సి.డి.ఈ.)వారీగా రిజర్వేషనుండదు. స్థానికసంస్థలలో అన్ని బీసీ కులాలకు కలిపి గంపగుత్తగా సింగల్ రిజర్వేషన్ ఉంటుంది.

రాష్ట్రంలో వెనుకబడిన తరగతులలో దారిద్య్రరేఖకు దిగువన ఉన్నవారికి అభివృధ్ధిపథకాలకోసం 1974 లో ఒక ప్రత్యేక బి.సి. కో-ఆపెరటివ్ ఫైనాన్స్ కార్పొరేషన్ ఏర్పాటైంది. ఏ.పి. పునర్విభజన చట్టం 2014 అనంతరం, AP BCCFC ను రెండుగా విభజించగా తెలంగాణారాష్ట్రంలో TSBCCFC Ltd. ఏర్పాటైంది. 02-06-2014 నుండి Co-operative Societies Act

How many of the 26 castes removed from the BCs list were from BC-A? Now, 13 are added into BC-A. So, competition level has increased for our community to occupy good positions in GoT jobs.
This is wrong. He was not a Delhi Sultan. Sultans are nonHindus. He was a Hindu Emperor of Chauhans of Ajmer and Delhi.
