Section 504 of the Rehabilitation Act of 1973 is a civil rights statute that prohibits discrimination against individuals with disabilities.
The law requires school districts with students with disabilities to be provided reasonable accommodations to allow access to educational programs and associated activities to the same extent as students without disabilities.
A student may be eligible to receive Section 504 Accommodations if he/she:
Has a physical or mental impairment, and
The impairment substantially limits one or more major life activities.
DoDEA schools provide a free appropriate public education (FAPE) to students with disabilities by implementing reasonable 504 Accommodations upon establishing that a student has a disability requiring such 504 Accommodations.
The 504 Instructional Systems Specialist (ISS) provides guidance for ensuring that processes and plans are compliant and students receive necessary accommodations.
The Pacific East has positively impacted Section 504 Compliance as evidence by:
100% due date compliance at the end of the 2020-2021 school-year.
100% of plans meet the minimum requirements.
Most 504 plans meet our best practice expectations now that the step-by-step guides are more user friendly and easily accessible.
DoDEA Headquarters:
The school psychology ISS at Headquarters, John Keating, also supported 504 Teams.
A schoology Group was created in the fall of 2015 for 504s where trainings, instructions, regulations and policies were made easily available.
Pacific East District:
Section 504 Teams were supported by the special education ISSes in the district, who referred individuals to the Headquarters Schoology Training materials.

During the 2017-2018 school year, the Pacific East District hired an district ISS to support School Psychologists, 504 Teams and School Nursing and the teams and tasks typically led by these individuals. The ISS:
Provided 504 training and engaged in reviews. However, this position was not included in the budgeting for the 2017 fiscal year, so no travel was possible to distant locations. All support, instruction, and monitoring were done online and by phone. Met with each 504 Team Coordinator individually to review their present knowledge, provided the guidance they seemed to need and worked with them on at least one 504 Plan walking through the steps in Aspen.
Created a summary of patterns seen and e-mailed to administrators and 504 Chairs.

In the 2019-2020 school year, DoDEA Headquarters provided guidance and flowcharts regarding who would handle 504 plans for students in DoDEA Virtual School (DVS) and reminded educators of commitment requirements for DVS.
The Pacific East District in the 2019-2020 school year:
Completed in-person visits to 504 Team Coordinators and checked to see that the paperwork in the files reflected what was in Aspen
Completed 504 reviews at least once quarterly for active 504 plans that had not yet been reviewed.
The 504 ISS was not able to review all 504 plans using this method all year, but discovered new patterns of strengths and weaknesses.
The errors of the past two years were mostly resolved.
Meeting minutes did not meet best practice guidelines.
Updated the 504 monitoring review form to include guidance related to changes from the old template to the new template and to include reminders regarding the weaknesses noted during the reviews and visits.
Supported remote learning due to COVID-19 from March to the end of the school-year.
Guidance for virtual meetings and memos for the record were provided so that any plans due during this shut-down period would continue to be followed until a new meeting could be held.
Folders, updated training, documents, and memos for the record were created to assist with situations resulting from school going so quickly to remote learning.
Documents were created for ease of use during virtual meetings.
In the 2020-2021 school year, DoDEA Headquarters:
Expanded DoDEA Virtual School to include k-12 students and a few changes in procedures needed to be made specifically regarding DVS and students with 504 plans.
Provided 7 school counselors and 2 support positions to DVS. Their enrollment was almost 11,000 students
Shared the DVS 504 process along with flow charts
In the 2020-2021 school year, the Pacific East District:
Supported 15 Students with Active 504 plans enrolled in DoDEA Virtual School, 149 Pacific East Students with active 504 plans as of October 13, 2020; 152 Active 504 plans as of October 26, 2020; 164 with active plan as of December 18, 2020.
Created an Expectation Memos to help staff members better understand what the ISSes for each program do.
Created 504 Teams Drive with private channels for each school that allow personally identifiable information (PII) to be uploaded. This allows for easier access to completed 504 reviews. Previously they were e-mailed when completed.
Provided 504 training at the beginning of the year and included slides with Google links to required and helpful documents.
Provided clear guidance for Incoming Non-DoDEA 504 plans
Developed and provided step-by-step guidance for several different processes.
Completed 504 reviews at least a month before the end date for every 504 plan, so that the guidance would be available for new draft plans:

Winter 504 training was provided by HQ through Schoology starting January 6, 2017.
Per a comment made by the HQ ISS in Schoology, as of October 27, 2016, there were 400 Pacific Region 504 plans and 22718 enrollment for 1.8%. However, 22 of these students (5.5%) also had IEPs. It was made clear that students should not be on both 504 plans and IEPs. Explanations were given for how to handle IEPs where students had disabling conditions other than their IDEA disability that also required accommodations.

The following concerns were noted (AUG-DEC 2017):
Meeting minutes were either not included at all or were often only included in the “summary” section of the plan itself. No separate minutes were taken.
There was no mention of parent rights being offered.
There was no parent invitation providing evidence that parents were invited to participate.
There was no evidence that drafts were being developed with input from all participants and provided prior to annual review meetings.
Teachers were not providing accommodation logs or other helpful data.
Student history and evaluation sections did not actually include any helpful information for the person following the plan. Instead they included the diagnosis and physician’s name, mentioned that observations were made and that teacher recommendations were given, without saying what was learned by the observations and recommendations.
Often only “Learning” was chosen as the limited major life activity which is rare.
Too many students had active or old 504 plans in the system, but were also on IEPs.
There were many plans in the system that had not been reviewed in more than a year.
The 504 Plan template at this time had drop-down accommodations listed by “Content Area/Settings.” Sometimes what the team meant to be a testing accommodation was listed in the “Classroom Assignment” Setting, so was not actually showing as a testing accommodation.
504 Accommodations were not always reasonable in their combination
504 Chairs need to be given time to review the 504 documentation and instruction provided at the beginning of each year and complete beginning of year 504 compliance procedures .
504 Chairs need to review instructions prior to developing plans.
Some 504 Chairs had so many responsibilities, tasks, and duties that making time for the 504 Chair responsibilities appeared impractical.

In-person visits were made to each 504 Chair to review the processes and provide direct support. Many new concerns were evident in person that were not evident from online reviews (AUG - DEC 2018):
Team Coordinators did not know how to print the Aspen Plan, so although they completed the plan in Aspen, they re-typed it onto old paperwork and printed and signed that instead.
If no changes were made to the accommodations, team members signed again with new dates right onto the old original 504 plan that also had original signatures.
Although the requirement was made in 2012 to use Aspen, at least one school was not using Aspen at all. All 504 plans were done on the old paper documents and were not entered into our SIS at all.
When they did enter new plans in Aspen, many were typing over top of old plans instead of creating new ones. So, the record of the old plan was removed from the system.
504 plans and meeting minutes which were being stored in the cumulative record mentioned medical diagnoses, medication, previous special education assessments or eligibility and other sensitive information not permitted to be stored in cumulative records.
Concerns were raised about the difficulty in finding time for these meetings to occur.

Many were not putting the expected information in the different boxes on the plan, which didn’t make it “non-compliant” also didn’t include expected information.
Some meeting minutes really said nothing. They often did not include full names of participants, did not include the discussion of WHY accommodations were being added or discarded, and often repeated information from the plan itself, which can cause problems if they contradict the plan.
