Letter of David Sutherland to Acting Surveyor General David W Smith, Esq. dated at Newark (Niagara-on-the-Lake) on 26 Aug 1795

“Dear Sir, Previous to my Departure for the States, I take the Liberty of writing you & Requesting your good offices in my behalf with His Excelly whom I regret sincerely not to have been at Newark during the sitting of Council—tho I had repeatedly waited on him to have the honor of a conference—and presuming that should any difficulty arise with His Excellency as to his granting me the Lot I have asked for on Nanticoke Creek. I take the liberty to inform you that should he be pleased to indulge me with the Lot which I think comprehends the Mill Seat, I will in the space of two years engage to build a grist Mill on it—In less than two months. “Respectfully shews That your Petitioners Father – Swayze joined the King’s Forces in the year 1776 & was employed throughout the war in many services of Trust & secrecy – That in the years 1783- being on his way to bring his Family into this Country, he was killed by the Americans, & before he could apply for Land – Your Petitioners therefore humbly pray your Excellency would be pleased to grant such Land to them in behalf of their said Father as to your Excellency may seem meet – and as in Duty bound Your Petitioners will ever pray—” [Unsigned] Read in the Executive Council on 12 Jul. “Humbly Sheweth That your petitioners Father served in Col Bartons Volunteers during the late American War—That your Petitioner came into this Province in the year 1786 with a wife and two Children, and has yet never drawn any lands, That your petitioner bought Six hundred acres of Land of Mr Robert Hamilton in the Township of Thorold where he resides—prays your Honor would be pleased to allow him such a grant of Land for himself; wife the daughter of a Loyalist- and Children as to your Honor may Seem meet and your Petitioner as in duty bound will ever pray—[Signed] peter Hopkins” Received at the Executive Council Office on 24 Mar 1797 and read in Council on 28 Mar 1797. “Humbly Sheweth That your Petitioner having long labour’d under the disagreeable and greatest hardship of being a person not thought worthy of being entitled to the privileges as a Free Citizen of this place, from the accusation of Levy Lewis in January 1789 before the Honourable Gentlemen. Now Your Petitioner being desirous to have all Doubts of Suspicion against his Character cleared as now, he hopes, provided with sufficient proofs as will take away such suspicions as the said Levi Lewis has since confessed before some Gentlemen that at the time he was before the Honorable Board in January 1789 he then did not know what he said and that if he said anything against your Petitioner it was only through Malice, and not from any fact he could affirm—Your Petitioner now waits with all due submission on the Honorable Board with his Petition to know whether he may be entitled to the same privileges as any other Free Citizen and be allowed to take up lands as such and what quantity the Honorable Board will please to allow him, the want of which has been of the greatest importance and loss to Your Petitioner who will ever Pray—[Signed] Isaac Swayze” No Executive Council order or dates on the petition. “Sheweth That your Petitioner erected Brick works and other Buildings on a Piece of Ground near the outlet of the two miles run between the west boundary line of the Town of New Ark and John Secords Farm on Lake Ontario, which piece of Ground he found to be vacant and had the same surveyed, which contains 16 Acres and as your Petitioner has expended a considerable sum of Money on the Premises in building &c he would be glad if your Excellency would give him a grant for the same or grant him such other relief as through your Goodness and Wisdom may seem meet, and your Petitioner in duty bound will ever pray—” [Unsigned] Read in Council on 24 May 1793. “Memorandum of an Agreement made and entered into this first day of December in the Thirty fifth year of his Majesty’s Reign at Newark in the Province of Upper Canada Between Isaac Swayze of the Township of Newark Esquire and George Mains of the same place on the one part and William Chewit of the Township of [blank] in the Eastern District of the other. Whereas the said Isaac Swayze is possessed of a certificate of location of lot Number 213 and the said George Mains hath sometime since presented to the late Land Board of this District a petition for certificate of location of lot number 214 in the said Town of Newark to the granting of which there does not at present appear any objections: And whereas the said Isaac Swayze and the said George Mains are desirous of disposing of their equitable claim to the said lots for a bona fide consideration, but because of the dissolution of the Land Boards, and because there is no Council at present sitting no regular assignment can be made of one lot and a certificate obtained for the other. This Agreement witnesseth that for and in consideration of the Sum of Seventy five pounds lawful money of the Province to the said Isaac Swayze and George Mains paid by, and by them now acknowledged to be received from, the said William Chewit they have each of them Do hereby assign over to the said William Chewit his heirs & assigns, all their and each of their equitable claim and demand to the said lots and each of them. And the said Isaac Swayze and William [sic] Mains do, and each of them for himself—his heirs, Executors and assigns against all others claiming or to claim the said lots or either of them, now or hereafter they will defend and they or either of them, their or either of their heirs Executors or administrators, shall and will obtain or cause to be obtained a good sufficient and indefiable title to the said Lots, for, and in favor of the said William Chewit as soon as the same can be procured. For the true performance whereof they the said Isaac Swayze and George Mains do bind themselves, their and each of their heirs, Executors and administrators in the Sum of one Hundred and fifty pounds lawful money of this Province to be recovered by virtue of these present. “Humbly Sheweth—That your Petitioner joined Col Butler’s Rangers in the year 1778, and Continued in them till the end of the War, when he was reduced with said Corps—That your Petitioner married the Daughter of Fredk Williams, who joined the Royal Standard previous to the Year 1783 and had one Child before the Year 1789—Wherefore Your Petitioner prays that your Honor would be pleased to allow him his Military lands, likewise such grant for his wife the daughter of a Loyalist, and for his Child as your Honor in your wisdom may Conceive proper – your Petitioner never having received any lands Either for himself, wife, or family – and your Petitioner as in duty bound will ever pray [Signed] Jacob Sipes” Received at the Executive Council Office on 18 Apr 1797 and read the same day.
