Upper Canada Land Petition of John Cane dated on 7 Aug 1795

“Humbly sheweth That he now possessed Lot No 25 in the Town of Newark which was formerly granted to the late James Fitzgerald as as the Certificate of the said Lott cannot be found it is supposed to be losed amongst many other papers at the time of his Death. Your petitioner therefor humbly prays Your Excellency will take His Case into consideration and grant him a Certificate or such other Deed for the said Lot as your Excellency may think propper. “Humbly Sheweth—That your Petitioner served in Butlers Rangers and has received 200 acres of Land—that he had a wife and one child before the year 1789—for whom he never received any Land prays your Honor would be pleased to grant him his additional 100 acres military Land, and one hundred acres Family Land—and your Petitioner as in Duty bound will ever pray—” [Unsigned] Added note of Thomas Ridout, N. He has a wife and two Children he therefore most humbly requests your Honors would assign him Lot No five in the Township of Hamburgh 1 Concession and that your Honors would be most graciously pleased to grant him a further location of Lands for himself and family as your Honors in your wisdom shall see fit and as in duty bound he will ever pray. Upper Canada Land Petition of Peter Caine of Newark (Niagara-on-the-Lake) dated at Newark on 7 Jul 1794

“Humbly Sheweth That your Petitioner from his predilictions to the British constitution and an affection for the best of Kings is desirous of spending the remainder of his life and bringing up his family under the government that is dearest to him of any on earth—Encouraged by His Excellency’s most gracious proclamation he, last Fall removed his family into this Province, and trusts that his conduct has since been such, as must convince all that know him that the probability of his becoming a useful Inhabitant is in his favour. Your Petitioner therefore most humbly begs leave to approach your Honors on the present occasion to inform your Honors that he has a wife and three children and that he feels himself under circumstances of cultivating lands on an extensive scale. He therefore most humbly prays that your Honors would grant him a location of one thousand acres of land and as in duty bound he will ever pray. “Know all men by these presents that I Peter Cain of the Home District of the province of Upper Canada, for a valuable consideration the receipt whereof I the said Peter Cain doth hereby acknowledge and confess – have granted, bargained, sold, aliened, leased and released, conveyed and confirmed, and by these presents do absolutely grant, bargain, sell, lease and release, convey and confirm unto Samuel Street of the District and province aforesaid, all that certain Tract or parcel of Land, messuage or tenement Granted by our Sovereign Lord the now king to William Orr lying, being, and situate in the Township of Gains Borough, known and described by Lot number fifteen in the fourth concession, and containing two Hundred acres, more or less: —To Have and to Hold, the above granted and bargained premises unto him the said Samuel Street his heirs and assigns forever. Upper Canada Land Petition of William Caldwell Esqr dated in Jun 1796

“Humbly Sheweth—That your Petitioner is a reduced Captain from Butler’s Rangers and has not yet received the lands he conceives he is intitled to as a reduced Captain: therefore prays your Excellency he may be permitted to locate Six or more Lots at the Back Creek in the rear of the farm he now occupies, and the residence at the place called the Plains, which your Excellency gave him leave to cultivate—Further represents, that on the 29th of December 1788—he obtained an order of the Honorable Council of Quebec in favour of his sons William and James Caldwell for a certain Marsh which was accordingly surveyed on the 6 and 7th of July 1790: that there being no timber thereon fit for fencing, he hopes a lot of wood land in the vicinity thereof will not be denied to each of his said Sons—And your Petitioner as in duty bound, will ever pray [Signed] W Caldwell” Read in the Executive Council on 5 Jul 1796. Ordered recommended that the lands the petitioner has already received may be made up to the quantity he is entitled to as a reduced Captain—The Committee do not think themselves warranted to go into the appropriation of particular lots in Malden for referring to a former offer of Council there appears to be something expected from Messrs. McKee, Elliot and Caldwell as to the lot division of that Township. The Plains are reserved and have been petitioned for by the widow McKellup. Upper Canada Land Petition of William Caldwell Esq: late Captain in Butlers Corps of Rangers and resident of Amherstburg dated at Amherstburg on 15 May 1797

“Most humbly sheweth that your Memorialist immediately after the Close of the late war and reduction of the Corps in which he served finding no provision made for the Soldiers who served under his Command obtained a grant from the Indians of that tract or parcel of land on Lake Erie now called the New Settlement which grant he ceded to Major Mathews the then commanding officer of this District by whose order the lands were surveyed and distributed to the aforesaid soldiers and other loyalists – that in consideration of this cession his Majestys Governor and Council of Quebec on Major Mathews application were graciously please to grant to his children a certain tract containing according to the then Surveyors plan three thousand and fifty acres making use in the said grant of the […] marsh which makes the greatest part of the tract. That his fellow trustees of the township of Malden are attempting to retrench the few lots of woodland within this tract (which alone makes it of any value) as not belonging to his Grant – Your Memorialist therefore most anxiously hopes and prays that your honor & his Majests most honourable Council will not allow a deviation from the spirit & sense of the aforesaid grant which derived from the favour and under the Auspices of the Right Honble Lord Dorchester and your Memorialist as in Duty bound will ever pray [Signed] Wm Caldwell” Received at the Executive Council Office on 16 May 1797 and read in Council on 8 Jul 1797. “Humbly Sheweth That your Petitioner is an old Man a discharged Soldier haveing served in the Kings York Volunteers under Governor Tryon during the late American War. Your Petitioner has a Wife and Two Children with Him in the Township of Louth District of Niagara – your Petitioner nor Family have ever as yet received any lands your Petitioner therefore Humbly Prays that your Excellency in Council will take his situation into Consideration and be pleased to grant him such allowance of Land as to your Excellency may appear meet and your Petitioner as in duty Bound will Ever Pray.” William Camell made his mark. “The Petition of George Campbell, of the Town of Newark County of Lincoln & province of Upper Canada, Carpenter who has a Wife and Six Children, joined General Burgoyne’s army in the Year 1777 & was one of the Guides to the said Army from Skinsborough to Saratoga—afterwards a Serjeant in the King’s Rangers—as appears by the recommendatory Certificates annexed & has resided since the war in these provinces. Respectfully shews: That your petitioner is desirous to settle on the lands of the Crown in this Province, being in a condition to cultivate and improve the same. That he is ready to take the usual oaths, and to subscribe the declaration, that he professes the Christian Religion, and obedience to the laws, and has lived inoffensively in the country which he has left. Prays your Excellency, would be pleased to grant such a number of acres of land upon the terms and conditions expressed in your Excellency’s proclamation bearing date the 7th day of February, 1792, as to your Excellency in your wisdom may think meet. “The Petition of George Campbell—carpenter 21 years of age—Respectfully shews—That your Petitioner has served nine years of apprentiship to George Young of the Town of Newark and purposes in a short time to set up his Trade—That your petitioner is desirous to settle on the lands of the Crown in this Province, being in a condition to cultivate and improve the same. That he has taken the usual oaths, and is ready to subscribe the declaration, that he professes the Christian Religion, and obedience to the laws, and has lived inoffensively in the country which he has left.
