Undated Upper Canada Land Petition of Andrew Ostrander of the Township of Stamford, County of Lincoln, District of Niagara, yeoman received at Government House on 5 Dec 1825

“Most humbly sheweth, That previous to the month of May 1823, James House, an Englishman, then of Chinguacousy Home District and Province of U Canada drew at the Public Office the Lot No 7 in the 4th Concession, West of the centre road of Chinguacousy containing by admeasurement 200 acres (more or less. That James House becoming indebted to your Petitioner, he for this, and for several other valuable considerations, entered into a Bond, bearing date the sixth of May one thousand eight hundred and twenty three, binding himself in the penal sum of £200 to vest full title by a transfer Deed in your Petitioner his Heirs and Assigns for ever, which deed was to be executed by the 1st Day of May then next ensuing. That Loyal O’Strander (sic), a Son of your Petitioner, in the confidence of this Bond, entered upon the possession of the Lot and commenced a regular series of improvements upon it. That the 1st May 1823 the time limitted in the above mentioned Bond, having arrived, James House made excuses and apologies for deferring the time of taking up his Deed and of transferring it to your Petitioner: and he continued thus to excuse himself, and to avert the execution of the Deed, until the month of October 1824, when he suddenly left the country, taking his Location Ticket with him, and set sail from the Port of New York in the United States; which information your Petitioner derived from a Letter received from a Brother of James House, who sailed with him; according to which Letter, James House sailed from New York on the 16th day of October 1824. That since the departure of James House, three Letters have been dispatched by members of your Petitioner’s family, directed to the house of the father of the said James House in England, to which, no answer whatever has been received. That it can be proved to your excellency, that James House previous to his departure, made at various times such intentions, as plainly prove tha he intended to defraud your Petitioner of his right to the above property: And a note which he held against Loyal, a Son of your Petitioner, he assigned to another hand previous to his departure, which Note, the said Loyal O’Strander has since been compelled to pay. That the improvements in the above Lot, made by your Petitioner’s Son Loyal, have been estimated by three veritable men at £75 lawful Cy. That in the event of Loyal your Petitioner’s Son being obliged to leave the possession of this property, the continued labour of more than 2 years, and a great expence otherwise, will be entirely lost by him, and he, together with his family will be reduced to indigence, deprived of a home, and compelled to being the world again; for he can find no remuneration in the paper shadow of a run-a-way Obligee who has left nothing behind him to sue for. Your Petitioner, therefore, most humbly prays… [Signed] Andrew Ostrander” [Upper Canada Land Petitions LAC “O” Bundle 14, Petition Number 35]

Upper Canada Land Petition of Andrew Ostrander of the township of Stamford in the Niagara District, yeoman dated in Niagara 8 June 1830

That should your Excellency be pleased to grant the prayer of his Petition your Petitioner is ready to pay the required fees: That about four or five years ago, your Petitioner by D. Lafferty presented a Petition to the then Lieutenant Governor to which was annexed the Said Bond given by the said James to your Petitioner, which said Petition prayed his Excellency that no Deed should issue in the name of the said James or of any other person, until your Petitioner should be relieved from his Bond and his son ren[…]grated for his Improvement. Wherefore your Petitioner humbly pray that your Excellency will be pleased to take his case into your consideration and in conformity to the wishes of the said James (as fully appear by the said Power of attorney) to order a Patent to issue in the name of the said Loyal Ostrander for the said lot of land and your Petitioner as in duty bound, will ever pray – Andrew Ostrander by his Attorney [Signed] John Lyons Niagara 8th June 1830” Read in the Executive Council on 12 Jul 1830 and ordered Loyal Ostrander must claim before the Land Commission.
