Upper Canada Land Petition of William Hare, Sarah Willard (formerly S. Hare), Mary Fairchild (formerly M. Hare) and Elizabeth Hare dated at Newark (Niagara-on-the-Lake) on 2 Apr 1793

“Most respectfully Sheweth That Your Petitioners are the Children & Heirs at Law of the late Captain John Hare of the Indian Department. That the said late Captn John Hare gave the most unequivocal proofs of his Loyalty from the first Appearance of rebellious Commotions in America, by taking a decided & active part for Government, and was one of those who accompanied Sir John Johnson in Spring 1776 thro the woods from the Mohawk River to Join the Royal Standard in Canada—That the said late Captain John Hare having been ordered to Join the Division of the British Army, destined to form a Diversion by the way of Fort Stanwix under Brigr General St Leger, was killed on the 6th of August 1777 in the Action fought at Oriska between a Detachment of the said Army & a strong Party of the Rebells commanded by their General Harkemer. That Your Petitioners hope that the right which the said late Captn John Hare held to Lands from the Crown, according to the Rank of his Commission, agreeable To His Majesty’s Proclamations and Orders on that Head was nowise diminished by the Sacrifice of his life in the Service of his Country—Wherefore Your Petitioners pray that Your Excellency would be pleased to grant them as Heirs to the said late Captn John Hare and in his right, Three Thousand Acres of the waste lands of the Crown to be divided among Your Petitioners as in right and equity may appertain and Your Petitioners as in duty bound will ever pray &c—for self & other Heirs [Signed] Willm Hare” Read in the Executive Council and ordered granted. Upper Canada Land Petition of Elizabeth Clark dated on 25 Feb 1797

“ Most Humbly Sheweth That your petitioner is the daughter of John Hare, who at a very early period of the late War in America from his attachment to the British Government fled to Canada and Joined the Royal Standar; (whence his whole family followed and joined him) in consequence of which, your petitioner’s Father was honored with a Captain’s Commission under Sir John Johnson. Undated Upper Canada Land Petition of the Heirs of the late Captain John Hare received at the Executive Council Office on 20 Jun 1798

“Humbly Sheweth, That your Petitioners having obtained an Order of Council for three thousand acres of land in right of their father, were desirous of locating in part of the same Lot number twenty in the third Concession and Lots number Sixteen & Seventeen in the fourth Concession of Saltfleet, which lots upon examination were found to have been entered in the name of a Person who had shortly after such entry removed his residence from this Province as will appear by the Certificate hereunto affixed. Your Petitioners therefore humbly pray, that Should your Honor find such Claim to be cancelled your Honor will be pleased to allow them to locate the said lots of Land: And Your Petitioners as in duty bound will ever pray &c. “May it please your Honor, In obedience to your Honors order of reference to me, on the petition of James Clark for the Heirs of the late John Hare, to report whether certain lots prayed for by them are vacant – I am to inform your Honor that the name of Enoch Moore stands upon the Quebec Plan of Saltfleet, for the following numbers, vizt Lot No 30 – 3d Concession – & lots No 14, 15, 16, & 17 – 4th Concession – containing 500 Acres – How far they may be considered vacant, will depend upon the construction your Honour in Council may be pleased to put on the Certificate attached to the Petition by Nathaniel Pettit Esquire, member of the late land board for the Home District—All which is submitted to your Honors Wisdom [Signed] D W Smith Esq Sur Gen Office 10 Feb 1799” Added postscript of D. That the said late Captn John Hare gave the most unequivocal proofs of his Loyalty from the first Appearance of rebellious Commotions in America, by taking a decided & active part for Government, and was one of those who accompanied Sir John Johnson in Spring 1776 thro the woods from the Mohawk River to Join the Royal Standard in Canada—That the said late Captain John Hare having been ordered to Join the Division of the British Army, destined to form a Diversion by the way of Fort Stanwix under Brigr General St Leger, was killed on the 6th of August 1777 in the Action fought at Oriska between a Detachment of the said Army & a strong Party of the Rebells commanded by their General Harkemer. “Humbly Sheweth That your petitioner at an early period in life having nearly attained the age of sixteen years joined the British standard in America, when he entered and served in the Capacity of a Volunteer for the space of four Years in a Corps of Rangers Commanded by Lt Col Butler, during which time your petitioner was generally employed upon Actual service. That your petitioner had frequently within this time been promised a Commission in some one of the provincial Corps, of which your petitioner was in full expectation, until on confirmation of those Officers being to be allowed half pay on their reduction, his hoped for Commission (as he supposes) was bestowed on some other person, To Compensate this, the Commanding Officer of the Corps, had frequently assured your Petitioner that every affort should be made by him, to obtain for your petitioner the allotment of land usually granted to a Reduced Ensign; without its ever being attempted. That your petitioner having been deprived of the aid of his Father who in his Country’s Cause lost both his wife & a very Valuable property, leaving behind him a widow and a helpless family of Children deprived of even the Common Necessaries of life- unto which until then they had been unaccustomed. “Humbly Sheweth That your petitioners mother was the widow of the late Captain John Hare who was Killed in the heat of Action at an early period of the war in America fighting in the Cause of his Country. That your Petitioners Mother on the Death of her husband was left with a numerous and burthensome family with but little to support them and having come into this Province was duly taken and considered as a loyalist and as such was directed by the then authority of the Province to take up & injoy for herself and family a certain Portion of Lands for which she had assurances of obtaining the necessary title with other persons settling in the same situation. That your Petitioners mother under those circumstances did locate and possess some lands in the Township of Louth as part of what she was intitled to and then made a very considerable improvement in so far as to make herself & Family comfortable; her death shortly afterwards prevented her laying Claim to the full quantity she was led to believe herself intitled to, and also prevented her obtaining any other title for those then possessed than by having her name duly and regularly inserted in the place of said Township of Louth where it will more fully appear. Mentioned in the Upper Canada Land Petition of Benjamin Cutler of the Township of Humberstone in the Niagara District Yeoman dated on 5 Feb 1811

“Humbly Sheweth That your Petitioner purchased the Front half of Lot number Six on Lake Erie in the Township of Humberstone from Edward Harp to whom it was originally granted. Edward Harp also sold one hundred Acres from off the rear of said Lot to another person and left the Province previous to the issuing of the Kings Patent. That your Petitioner laid his claim together with the other persons before the Honorable Commission Court held at Niagara for deciding such cases. Mr. Justice Allcock presided—The result was that your Petition obtained leave to get the Deed in the name of Edward Harp, which he did & went after the said Edward Harp into the United States obtained from him a Transfer Deed for the whole Lot.; obligated himself to convey one hundred Acres from off the rear of the said Lot to the Person to whom the said Edward Harp had sold it; And conveyed the said one hundred Acres to David Bearss (the person to whom it was sold) agreeably to his obligation—It was taken for granted that the said Edward Harps Deed was intended & did extend from the Bank of the Lake to within one Chain of the Front of the Second Concession, but it has lately been Surveyed by a Deputy Surveyor, and found that there are Fifty Acres and Eight tenths more than was known in the Surveyor Generals Office and consequently the same number of Acres more than was intended to be described in the said Edward Harps Deed—This Fifty Acres and Eight tenths is part of the Land your Petitioner conceived he had conveyed to the said David Bearss, and is the self same Land upon which the said David Bearss has cleared considerable of Land and a built a good Dwelling House. And that the Front part of the said Lot is a Tamarack Swamp and is thereby rendered unfit for cultivation as may be seen by the Surveyors report to the Surveyor Generals Office. Wherefore your Petitioner prays that your Excellency may be pleased to Grant him the vacant Land in rear of that granted to the said Edward Harp, to enable him to Guarantee the Deed of Conveyance given by him to the said David Bearss—Your Petitioner humbly begs leave to state that should his prayer be favorably answered, he is ready within three Days from the date of the Order in Council, to pay into the Receiver Gernerals Office the Amount of the Fees that may be attached to the Grant—And your Petitioner as in duty bound will ever pray.” [Signed] Benjamin Cutler.
