“Humbly sheweth That your Petitioner served in Bartons Corps during the american war& that he came to this Province in the year 1786- with a wife and three children—and received a Ticket from Capt Watson, then Commd. at Niagara for 700 acres of Land—which certificate was since lost in the Hurricane—that his wife- Sarah, is Daughter of Peter Hendershot, late of the above named Corps- Your Petitioner therefore prays your Honor would be pleased to grant him his own and family Lands—and 200 acres in right of his wife, and your petitioner as in duty bound will ever pray—” [Unsigned] Added note of Thomas Ridout, N. Upper Canada Land Petition of Christian Hendricks dated at Niagara on 20 May 1796 [using a pre-printed form with fill-ins]

“The Petition of Christian Hendricks who having received the annexed recommendation Respectfully shews, That your petitioner is desirous to settle on the lands of the Crown in this Province at Long Point Settlet, being in a condition to cultivate and improve the same. That he has taken the usual oaths, & is ready to subscribe the declaration, that he professes the Christian Religion, and obedience to the laws, and has lived inoffensively in the country which he has left. Prays your Excellency, would be pleased to grant him Two Hundred acres of land at Long Point Settlemt upon the terms and conditions expressed in your Excellency’s proclamation bearing date the 7th day of February, 1792, or such other quantity of land as to your Excellency in your wisdom may think meet. “By way of Postscript to a Letter from the Surveyr General to Mr President Russell – dated 26 October 1796—is written — I take the liberty of observing, that Boughners certificates are only for 300 acres —

The Lots entered to Jacob Boughner were Lots No 1, 2, & 3 in the 2nd Crowland & Lot No 13 in the 7th Concession of Willoughby — They all adjoin each other — Christian Hendricks having lodged a warrant of Survey (No 535) dated 27 Septemr 1796 — the Lots No 1 & 2 in the 2nd Concession of Crowland have been accordingly described for him – (No 2377) —

It does not appear that Chrr Brillhart never received any Lands – & Lot 3 – in the 2nd Concession of Crowland having been disclaimed by Bougener – it has been described (No 1483) for Nicholas Misener, under a Magistrate’s Recommendation.

The Lot therefore in Willoughby No 13 – in the 7 Concession, which Brilhart was to have covered, remains yet with Boughners name upon it—but it has been greatly improved by Joshua Bennet – who has an order in Council of the 31 July 1797 for 200 acres of Land—100 acres of which has been described for him (No 6066) being Lot No 10 – 6 Concession of Willoughby – the other is unlocated – in the expectation of obtaining 13. 7 Con: of Willoughby, which he has so much improved, when Jacob Bougener shall have obtained the order in Council for describing the 300 acres, located by him in the Township of Woodhouse – in lieu thereof & of the Lots 1 & 2 – second Concession of Crowland. “Book of Letters recd No 5 – pages 1462, 1463 (Extract) Springfield 26 October 1796 Bougener appears to have 400 acres in Willoughby, and he prays to exchange 300 acres only for the like quantity at Long point – consequently the Certificates for Willoughby cannot be cancelled yet, as he will still hold 100 acres thereon—I can have no objection to Chrs Hendrick and Chr Brillhart having Bougeners 300 acres in Willoughby, if they have an order of Council for that Quantity — I return the certificates to be arranged before they are cancelled (Signed) Peter Russell”

Upper Canada Land Petition of James Henry dated at Newark (Niagara-on-the-Lake on 14 Aug 1795

“Humbly Sheweth That your Petitioner after serving His Majesty during the American War in Coll Butlers Rangers, settled in this Province near the 30 Mile Creek towards Burlington Bay where he has cleared a Farm, and has the same under Good cultivation. Your Excellencys Petitioner has labored hard since the said Corps of Rangers were Disbanded, has One Hundred Acres of his Land within Good Fence and under Tillage, and if unshaken Loyalty as a Soldier, and industry as a Citizen, has any weight in his claim to your Excellencys notice he flatters himself that he will receive benefit thro’ your Goodness—Your Petitioner Located (in his own name) but 200 Acres, Wherefore he hopes your Excellency will please to give him a further Grant as he has a growing Family of children; and your Petitioner in duty bound will ever Pray—[Signed] James Henry” Received at the Executive Council Office on 17 Aug 1795. Upper Canada Land Petition of James Henry dated at West Niagara 5 Sep 1797

“Humbly sheweth – That your petitioner served during the late american war in the late Col. Butler’s Rangers – that He married Catharine the Daughter of Hermanus House a Loyalist as the Certificate annexed will make appear – that he has five children—therefore prays your Honor to be pleased to grant him such Lands for his wife & family as your Honor may think meet & as in duty bound will ever pray—” James Henry made his mark. Received at the Executive Council Office on 7 Nov 1797 and read in Council on 8 Nov 1797. Ordered the Petitioner’s wife recommended for 200 acres, the certificate not sufficient for family lands. Upper Canada Land Petition of Philip Henry of the Township of Gainsborough dated at Newark (Niagara-on-the-Lake on 27 Jul 1795

“Humbly sheweth That your Petitioner, in the Royal North Carolina Volunteers, served as a private Soldier during the whole of the american war and was taken at York in Virginia—That he lived since the Peace, at New Brunswick till about three years ago, when he came with his Family to this Province, and has received two Hundred Acres in Gainsboro’—where he has made considerable improvement. Your Petitioner hopes your Excelly will not deem him too unreasonable in asking four Hundred acres of Land in addition to what he has received—and prays the same may be granted him of the vacant Lands of the Crown in the Province, and your Petitioner as in Duty bound will ever pray—[Signed] Philip Henry” Received by the Executive Council on 20 Jul 1795. “Humbly shewith that your Petitioner arrived here from N Britain in the year 1785 and has resided in this place ever since—During which period he flatters himself that he has behaved as a faithful Subject and a good Citizen and has expended considerable property in building and improving Land—And that your Petitioner has already Obtained from Government four hundred Acres of land for himself and family. Your Petitioner humbly Prayeth that your Excellency in Council will grant him an additional quantity of Eight hundred Acres or such a quantity as your Excellency shall think proper and and [sic] your petitioner shall as in duty bound Ever Pray” [Unsigned] Received at the Executive Council Office on 20 Jun and read in Council on 8 Oct 1796. Upper Canada Land Petition of Andrew Heron, of Newark, Niagara dated at York on 29 Jun 1798

“Humbly sheweth – That some time in the year 1795 – a certain John Van Voist came into this Province from the Mohawk River, with his wife and an Infant child – and that the Honorable the Executive Council were pleased to present him the two Hundred acres of Land, being Lot No 12 in the 12th Concession of Windham, and Lot Number 108 in the Town of Newark – That soon after the arrival of the said J. Van Voist, he and his family became sick in the Town of Newark, and after much distress and suffering the Husband died – that during his illness the incurred debts for House-rent – medical assistance & other necessaries – So that the wife became widowed in difficulties – That an order to [……] them, & to be enable to return to her friends on the Mohawk River, she was compelled to dispose of the Town Lot, then under assignment for her late Husband – and the two Hundred acres (at that time under order of Council) – which she voluntarily did [sell] Mr Andrew Heron & Andrew Templeton of Newark, & was thereby put in a Condition to return to her Family as she desired—Your Petitioner respectfully lays before your Honor the writings executed by the widow Van Voist – & having become answerable for her Deeds – and purchased the Lot sold by her to Andrew Templeton; he prays your Honor would be pleased to authorise the Secretary of the Province to deliver to him the Patents for the aforesaid Lands, now lying in his Office – on paying the accustomed fees and that he may be confirmed in the possession thereof by a Deed issuing in his own name, or otherwise as to your Honor may seem meet, and your Petitioner as in Duty bound will ever pray—by his attorney—[Signed] T Ridout N.P” Received at the Executive Council Office on 11 Jul 1798 and read in Council on 14 Jul 1798. Upper Canada Land Petition of Andrew Heron dated at York (Toronto) on 4 Aug 1801

“humbly Sheweth that some time in the year 1797 before the 6th Septr in that year he purchased of Mr Allan McNabb then at Niagara one thousand Acres of land located in the Township of Blenheim as will fully appear by writings herewith and that some time in the year 1799 he applyed to the honble Council that the Grant Might come out in your petitioners name which was refused him owing partly he understood that the Honble Council considered the price too low and that his Wife and Children were to be considered. Your petitioner anxious only to recover what monies he had advanced applyed to Mrs McNabb and offered her what ever the land could be sold for (in the course of a year) over and above the monies advanced by your petitioner with Interest he also advanced her 50 dollars for which She engaged to provide him a grant free of all expences as will appear by writings herewith to empower your petitioner more fully to dispose of the land he received from Mr McNabb, a power of Attorney (pursuant to one She had recd of her husband to Sell said land. Your petitioner is Sorry to find that application has been made to your Excellency in Council last April by Alexr Macdonell Esqr that the said land might be granted him to discharge a debt due to him by the said Allan McNabb which was referred to the Secretary of State and that in the meantime the Grant be stayed in the Attorney Generals office. Your petitioner humble prays that if your Excellency will not order the Grant to come out in his name that every obstruction may be removed that might hinder it coming out in the name of the Original Grantee or if that cannot be done that your petitioners Claim may be lade before the Secy of State Also that the Grant may be Stayed till he is also hear and your petitioner will as in duty bound ever Pray [Signed] Andrew Heron” [Upper Canada Land Petitions LAC “H” Bundle 5, Petition Number 23b]

Received in the Lieutenant Governor’s Office at York on 6 Aug 1801. “Observations on the Petitions of Mr Andrew Heron & Alexander McDonell Esqr. The Lieut Governor does not mean to interrupt the course which Mr Allan McNabb’s order in Council would have taken had not these Petitions been presented – not intending from any information yet brought before him, to decide or interfere in the premises. `Humbly shews—That your Petitioner is the Step Son of Philip Gregory of the 4th Township or Louth—& that he is lately married to Sarah the Daughter of John Davis late of Sir John Johnsons Corps—That your Petitioner having never received any Land- prays your Honor would be pleased to grant him 200 acres as a Settler and 200 acres in right of his wife, the Daughter of a Loyalist—and your petitioner as in Duty bound will ever pray.” Patrick Heron made his mark. It is unnecessary to inform your Honors that the volunteers in the city of New York clothed and armed themselves and that they served without pay. your Petitioner begs leave further to inform your Honors that his services are well known to Mr Plater and several other gentlemen in this settlement. He has never has [sic] as yet taken any lands except by purchase since he has been in this Province. your Petitioner therefore most humbly presumes to hope that your Honors will make some distition [sic] between him and a common settler, and that your Honors will not think him too presuming in humbly praying your Honors for a grant of [crossed out] of Land. “Humbly Sheweth That immediately after His Majestys Troops evacuated Philadelphia your Petitioner went to New York for protection having first experienced the affects of persecution, in 1780 he entered in Captain Templetons Company of City Volunteers and continued to do duty in that Company till after the arrival of Lord Dorchester. If the principles of Loyalty and an early emigration to this Province has any weight in your petitioners claim to a grant of Land, he is conscious your Excellency will do him strict Justice. Therefore prays a Grant of One Thousand Acres in the Tenth Township, or such relief as your Excellency has in General been pleased to give to suffering Loyalists under the same description of yr Petitioner, and he in duty bound will ever pray. “Humbly Sheweth That Your Petitioner purchased on the 1st May 1820, as appears by the Bond herewith, Lot number 31 in the 8th Concession of Esquesing from One David Steward, who bought from Wm Lewis Smith the Locater. That Your Petitioner has paid Sixty Dollars an account of the purchase money, and has cleared and farmed about 12 Acres of the Lot and resides thereon. That Your Petitioner finds the Locater has, subsequently to the Sale by him to Smith, & by Stewart to Your Petitioner, also sold the said Lot to Mr John McEwan of Niagara, who has the Location ticket in the Name of said Smith, thereby your Petitioner will be prevented from getting a Conveyance of said Lot from the Locater.
