Attorney General Responds to MSHSL, MASSP & MASA Request for Clarification on Transgender Student Participation in Athletics
The recent Presidential Executive Order, Keeping Men Out of Women’s Sports, regarding student-athletes raised questions from the MSHSL, MASSP, and MASA members as to how to follow the order while also complying with the Minnesota Human Rights Act. In response to the questions raised the three organizations sent this letter on February 14 to the Minnesota Attorney General’s office seeking clarity.
On February 20, Attorney General Keith Ellison issued this opinion. You may have already seen this document in an email from Laura Mackenthun of the MSHSL, sent to all superintendents on the afternoon of February 20. The AG’s opinion makes it clear that, at this time, Minnesota’s laws are what school districts and the MSHSL must follow.
