PRIVATE SCHOOL CHILDREN WITH DISABILITIES
Private School Documents and Information
Definition:
Children with disabilities enrolled by their parents in private schools or facilities other than public schools or agencies.
Child Find:
The District has an obligation to locate, identify, and evaluate all private school children with disabilities, including religious school children, when schools are located within district boundaries. Student Services staff will consult with appropriate representatives of private school children with disabilities on how to carry out child find activities.
Parents register at the neighborhood school, and the team completes evaluation planning and obtaines a signed consent for evaluation.
Team completes a comprehensive evaluation and determines eligibility
If the student is found eligible for Special Education offer a Service Plan
Obtain a signed statement of initial provision for special education
If the parent does not want services for their student who is parentally placed in a private school
Have the parent document this decision in writing each year
Stand ready notice is offered each year
Eligibilities must be kept current(every 3 years)
Provision of Services:
Federal regulations require the District to spend the same proportion of its federal funds as the number of private school children with disabilities residing within its jurisdiction. This number will be determined by conducting an annual count on December 1 in consultation with private school representatives.
Considering the number of private school children with disabilities, their needs, and their location, the District will consult with private school representatives, including parents, to decide:
Which children will receive services
What services will be provided
How and where the services will be provided
How the services provided will be evaluated
The final decision with respect to the services to be provided to eligible private school children is made by the District.
If a child will receive special education or related services, the District will develop, review, and revise a Services Plan. The Services Plan will describe the specific special education and related services it will make available to the child (similar to an IEP).
Limitations:
No private school child with a disability is entitled to any service or to any amount of service the child would receive if enrolled in a public school.
Private school children with disabilities may receive a different amount of services than children with disabilities in public schools.
The District is not required to provide transportation from the child’s home to the private school.
