Revocation of Special Education Services (termination of all special education services)


A parent may revoke special education services for their student at any time. This termination of all special education services will return the student to general education status as a non-disabled student.

Please follow the required procedures upon receiving a request from a parent to revoke all special education services:

    1. Contact Student Services Feeder Team Administrator for consultation.

    2. Although it is not required, it is best practice to attempt a face to face with the parent.

    3. The parent must put the revocation of special education services in writing. The District cannot move forward without a written request. An email meets this requirement and a copy must become part of the student’s record.

    4. Complete a Prior Notice(click here) to terminate all special education services based on the parent’s written request to revoke special education services. Do not terminate services until parents have been provided the Prior Notice at the meeting. A sample form is attached.

    5. Distribute copies of the Prior Notice to Student Services, student cum file, case manager’s working file, and parent.

      1. The District is not required to amend, change, or remove any references or paperwork that the student received special education and related services from the student’s file. If the parent requests to resume special education services after revoking special education services, it must be considered an initial evaluation. The IEP team must consider existing information in determining what assessment is needed for eligibility and determining special education and related services. Parents may not choose to revoke partial special education services; the revocation rule applies to all services. Disagreement with provision of a particular service must go through the IEP process.

    6. Student status after revocation goes into effect:

      1. The refusal of consent will have the effect of returning the child to general education as a nondisabled child; no special education supports will be provided.

      2. The child’s special education records will remain in their file.

      3. The parent you may refer the child for special education services at any time. If the child is referred, the District will hold an evaluation planning meeting to decide what evaluation, if any is needed, and get written parental consent for evaluations. The District may also refer the child for an evaluation.

      4. The child will have access to educational programs and standard accommodations, if any, that are available to other children in the general education setting.

      5. The District is not required to provide a free appropriate public education, conduct a three year re-evaluation, or hold annual IEP meetings.

      6. The procedural safeguards in the Notice of Procedural Safeguards will not apply.

      7. The school will apply regular discipline rules. The District is not required to determine whether the conduct of the child is a manifestation of the child’s disability before implementing regular disciplinary procedures.
