Parent Refusals

Parents or Adult Student can Revoke a Consent for Evaluation prior to completion of the activity or action for which they have given consent:

    • Revoke consent for evaluation for and evaluation that has not yet been conducted in writing

    • Revoke consent for the provision of Special education services in writing

    • Revoke consent for the release of personally identifiable information in writing

A revocation is not retroactive and requires a Prior Notice of Special Education Action for each of the above items.

Questions and Answers Regarding Refusals

What happens when a parent refuses to sign for an Initial Evaluation and checks the box "refusal" on a Consent for Evaluation?

    • Do not evaluate

    • Write a Prior Notice of Special Education Action to close the loop on the process

    • Document in meeting minutes

    • Consult with your student services administration, and or support specialist

What to when you've requested an re-evaluation, and the parent does not respond to the consent request?

  • Document all attempts to contact the parent to obtain the signed consent for evaluation

      • A minimum of 3 documented attempts are required before you can test, not including intelligence testing

      • Intelligence testing requires a signed consent for evaluation

      • Consult with your student services administration, and or support specialist

  • If the parent refuses specific tests requested

      • Document refusal

      • Do not evaluate

      • Use existing data to either establish eligibility or find the student not eligible for special education

      • Document in a Prior Written Notice and distribute

      • Consult with your student services administration, and or support specialist

What happens when a parent refuses to sign the Initial Provision of Special Education Services?

    • Student remains a general education student

    • Do not provide special education services

    • Do not remove the student from the general education classroom

    • Write a Prior Notice of Special Education Action "District stands ready to serve"

    • Document in meeting minutes, and in OrSped

What to do when a parent or member of the team disagrees with the team in determining eligibility?

    • Any member who disagrees with the team in the eligibility decision must write a written statement of their disagreement.

      • Attach documentation to the eligibility packet

    • Write a Prior Notice of Special Education Action
