METHOD OF EVALUATION

Students will be assessed on the basis of a midterm (25%) and a final exam (75%).

 

 

COURSE DESCRIPTION

The course will examine the rules governing unjust enrichment and restitution. Broadly speaking, the subject will be divided into seven sections:

·         Introduction

·         Enrichment to the Defendant

·         Corresponding Deprivation to the Plaintiff

·         Absence of Juristic Reason

·         Defences

·         Restitutionary Responses

 

If time permits, the course will address:

·         Disgorgement of Wrongful Gains
