COURSE DESCRIPTION: 


The objective of this course is to engage in an in depth consideration of a number of significant tensions within the Canadian federation, and the efforts our courts and political institutions are making to address them. These tensions concern the reconciliation of differing provincial interests with the interests of the nation as a whole, and the challenges of respecting provincial autonomy in a highly interconnected world in which problems transcend provincial and even national boundaries. Of particular interest are consideration of how our courts are adapting the doctrines and principles underlying Canadian federalism to address these challenges, and consideration of the implications of these developments. This will involve detailed consideration of a number of recent judicial decisions concerning Canadian federalism, including Reference re Greenhouse Gas Pollution Pricing Act, Reference re Environmental Management Act (British Columbia) and Reference re Pan-Canadian Securities Regulation.
