METHOD OF EVALUATION

The primary method of evaluation in this course is a paper worth 75% of the Grade.


The remainder of the grade in the course will be made up of: 


one (1) oral presentation worth 15% each

class participation worth 10%




COURSE DESCRIPTION

Examination of the rapidly growing, extremely diverse and increasingly important law of fiduciaries. Fiduciaries have protective responsibility for the interests of other persons, usually vulnerable persons. Topics covered will include the nature of the fiduciary relationship, obligations of fiduciaries, and remedies for breach of fiduciary obligation. Fiduciary relationships include a large number of critically important relationships including the relationships of professional service providers and their clients, patients, partners, principals and agents and directors and senior management and corporations.  Some attention will be paid to "unexpected" fiduciary relationships and the interrelation between fiduciary law and other sources of liability.
