METHOD OF EVALUATION

This is a pass/fail course. Student will be evaluated on a series of practical exercises completed individually and in teams, as well as an end-of-semester individual debrief. The practical assignments will allow students to become involved in different aspects of a hypothetical piece of public interest Charter litigation, the topic of which will be selected over the summer in consultation with students registered in the case. Exercises will include: interviewing clients, drafting pleadings, drafting affidavits, and written and oral arguments. 



COURSE DESCRIPTION

This course examines the theory, practice and ethics of civil litigation process, with a particular focus on how these issues arise in public interest litigation. It will provide students with an opportunity to explore substantive topics in civil procedure in-depth and to apply that knowledge through a series of practical exercises, detailed above in “Method of Evaluation”. Substantive topics covered will include: advanced costs and other litigation funding strategies, stare decisis, class actions, summary procedures, discovery and freedom of information requests, injunctions, and ethical issues for movement lawyers and government lawyers.
