Jemsek Ruling

Dr. Joseph Jemsek, a well-known Lyme treating physician, applied for a Maryland medical license and was denied by the Maryland Board of Physicians for not following what the NC medical board deemed to be the accepted "standard of care" for Lyme disease when he was practicing in North Carolina. The Maryland standard-of-care was recently set in stone by the Maryland Board of Physicians when they were forced to revisit doctor protection issues after a handful of people in and around Washington, DC attempted to have unacceptable bills passed in Maryland and Virginia. When the bills failed to be passed they continued to push the issue and demanded the Maryland Board of Physicians "do something". They did. Because of their efforts, Maryland has gone from being one of the best places for Lyme treating doctors to practice medicine to being the worst.

The Board found that the violations of unprofessional conduct in diagnosing and treating patients, failing to inform his patients adequately of the risks of his treatment and failing to conform to standards of acceptable and prevailing medical practice, for which he was disciplined in North Carolina, are violations of grounds of the Maryland Medical Act and constitute reasons to deny his application for licensure.
