ARTICLE V, Administration and Enforcement

§ 250-35. Enforcement.

This chapter shall be enforced by the Enforcement Officer designated in Chapter 7 of this Code. No building permit or certificate of occupancy shall be issued by him except where the provisions of this chapter and other provisions of this Code, local law, rule or regulation of this village have been complied with.

§ 250-36. Building permits; fees.

A Building permits.

(1) No building or structure shall be erected, added to or structurally altered until a permit therefor has been issued by the Enforcement Officer. Except upon a written order of the Board of Appeals, no such building permit or certificate of occupancy shall be issued for any building where said construction, addition or alteration or use thereof would be in violation of any of the provisions of this chapter.

(2) There shall be submitted with all applications for building permits two (2) copies of a layout or plot plan, drawn to scale, showing the actual dimensions of the lot to be built upon, the exact size and location on the lot of the building and accessory building to be erected and such other information as may be necessary to determine and provide for the enforcement of this chapter.

(3) One (1) copy of such layout or plot plan shall be returned when approved by the Enforcement Officer, together with such permit, to the applicant upon the payment of the fee as hereinafter provided.

B Fees. Fees, which shall be paid to the Enforcement Officer upon the filing of application for a building permit, shall be as determined by resolution of the Village Board.

§ 250-37. Certificates of occupancy; fees.

A Certificates of occupancy.

(1) No land shall be occupied or used and no building hereafter erected, altered or extended shall be used or changed in use until a certificate of occupancy shall have been issued by the Enforcement Officer, stating that the building or proposed use thereof complies with the provisions of this chapter.

(2) No nonconforming use shall be maintained, reviewed, changed or extended without a certificate of occupancy having first been issued by the Enforcement Officer.

(3) All certificates of occupancy shall be applied for coincident with the application for a building permit. Said certificate shall be issued within ten (10) days after the erection or alteration shall have been approved as complying with the provisions of this chapter.

(4) The Enforcement Officer shall maintain a record of all certificates, and copies shall be furnished, upon request, to any person having a proprietary or tenancy interest in the building affected.

(5) No permit for excavation for or the erection or alteration of or repairs to any building shall be issued until an application has been made for a certificate of occupancy.

(6) The Enforcement Officer shall also be authorized to issue a certificate of occupancy or of code compliance in connection with the purchase and/or sale of real estate after the Enforcement Officer has inspected the premises and found it to be in compliance. The fee for such a certificate shall be governed by Subsection B.

B Fees.

(1) Fees, which shall be paid to the Enforcement Officer prior to the issuance of either a certificate of occupancy or a certificate of code compliance, shall be as determined by resolution of the Village Board.

(2) Applicants to the Zoning Board of Appeals for zoning amendments are charged for the cost of public notices required on their behalf.
