Chapter 23, MARINA COMMISSION
GENERAL REFERENCES
Parks and recreation areas-- Sec Ch. 163.
§ 23-1. Establishment
It is hereby determined that the power to equip, operate and maintain the land, docking facilities and buildings located along the southerly shore of the Barge Canal, which were recently licensed by the State of New York to the Village of Ilion, shall be exercised by a Marina Commission, which is hereby established.
§ 23-2. Membership; terms of office
The Marina Commission so established shall consist of five (5) persons, residents of said village, to be appointed by the Board of Trustees of said village and to serve for terms of five (5) years or until their successors are appointed, except that the members first appointed on such Commission shall be appointed and designated for such terms that the term of one (1) of each of said Commissioners shall expire annually thereafter.
§ 23-3. Compensation of members
The members of said Commission shall serve without pay.
§ 23-4. Vacancies
Vacancies in such Commission occurring otherwise than by expiration of term shall be for the unexpired term and shall be filled in the same manner as for original appointment.
§ 23-5. Officers; promulgation of rules of procedure
The members of the Marina Commission shall elect from their own number a Chairman and a Secretary and other necessary officers to serve for one (1) year and may employ such persons as may be needed pursuant to law. The Marina Commission shall have power to adopt rules of procedure for the conduct of all of its business within its jurisdiction.
§ 23-6. Quorum
Three (3) members of such Commission shall constitute a quorum, and no action shall be taken except by the concurring vote of three (3) members.
§ 23-7. Journal of proceedings; budget; other reports
A. The Commission shall cause to be kept by its Secretary a journal of its proceedings.
B. There shall be presented annually by said Commission to the Board of Trustees of the Village of Ilion a tentative budget showing anticipated expenditures tor such fiscal year, and said Board of Trustees shall include in the annual budget of the Village of Ilion such sum as said Board of Trustees shall deem necessary, if any, to defray such expenditures. All funds so appropriated shall be in the custody of the Village Treasurer. No expenditures, however, shall be contracted for by said Marina Commission without the approval and consent of the Board of Trustees of the Village of Ilion, and all expenditures for marina purposes shall be incurred, transacted, presented, audited and paid in the same manner as other expenditures of said Village of Ilion and subject to the restrictions and conditions governing payment of claims against said village.
C. Said Marina Commission shall also furnish said Board of Trustees with such reports as may be required from time to time.
§ 23-8. Gifts of money
Any gift or bequest of money received for marina purposes, unless otherwise provided by the terms of the gift or bequest, shall be deposited with the Village Treasurer to the account of the Marina Commission, and the same may be withdrawn and paid out in the same manner as moneys appropriated for marina purposes.
§ 23-9. Maintenance of facilities; hiring of employees
Said Commission shall have authority to establish and maintain a marina and other facilities reasonably connected with the operation of such marina and, for the purpose of carrying out such objects, may employ such employees as it deems proper, subject, nevertheless, to the provisions set forth §23-7.
