Chapter 187, Skateboards

§ 187-1. Definitions
For the purposes of this chapter the following terms shall have the meanings indicated:
SKATEBOARD -- A platform which is mounted on wheels, having no mechanism or other device with which to steer or control the direction of movement thereof while being used, operated or ridden.
§ 187-2. Restricted within village
Operation of any skateboard is hereby prohibited within the roadways and on the pedestrian sidewalks in the following locations: Otsego Street; West Street from Second Street North to Main Street; Morgan Street; Second Street North to First Street; First Street; First Avenue; Second Street; Barringer Road; Main Street; Route 5-S; Central Avenue; Hope Street; North Central Plaza Parking Lots; South Central Plaza Parking Lots; East State Street to Hope Street; Remington Avenue; Hoefler Avenue; High Street; Armory Street; Russell Park Road, from Phillip Street to Park Street; East Clark Street, from Central Avenue to Catherine Street; on West Clark Street from Central Avenue to West Street; Beech Street; Maple Place; Hess Avenue; View Terrace; Orchard Street; McCann Street; all municipal parking lots while open; Weisbecker Hill; Bellevue Avenue; Sixth Avenue; North 5th Avenue, from Second Street to Montgomery Street; Center Street, between South 5th Avenue to South 4th Avenue; Park Street; Arlington Avenue; Highland Avenue; Shull Street; John Street; Second Street South to Third Street; General Business District bordered by West Street on the west, Otsego Street on the east, Route 5S on the north and 1st Avenue on the south; Grove Street; Brook Street, from Elm West to Harriet; Prospect Avenue, from Grove Street to Fourth Street; Benedict Avenue and on any and all business or manufacturing premises without prior approval of the owner.
§ 187-3. Penalties for offenses
Any person found violating the above section shall have his skateboard immediately inpounded. In the case of a first offense, the skateboard will be returned to the rider at the Ilion Police Station upon the appearance of the rider, if the rider is of age eighteen (18) years or older, or appearance thereof of the rider accompanied by his or her parent or guardian, if the rider is under the age of eighteen (18) years. In the case of a second offense, the skateboard shall be taken from the rider and not returned to him or her for fifteen (15) days, upon appearance at the Ilion Police Station as aforesaid. In the case of a third offense, the skateboard shall be taken away from the rider and not returned to him or her for one (1) year from the date of the violation, upon appearance at the Ilion Police Station as set forth above. If the skateboard is not claimed at the Police Station after a year and a half, the police may dispose of it in accordance with provisions for disposing of property under the New York State Personal Property Law as lost and found property.
