ARTICLE IV, Duties of Officers
C-20. Mayor.
The Mayor shall be the executive officer of the village, and it shall be his duty to receive complaint of any violation of this act or of any of the bylaws, rules, regulations, ordinances or local laws of said village and to see that the same are faithfully executed and observed and to prosecute in the name of the village for all offenses against the same.
C-21. A: Clerk
The Clerk of the Village of Ilion shall be appointed by the Mayor with the approval of a majority of the Village Board, and the Clerk’s appointment shall be for a period of four (4) years. The Clerk shall have such duties as are currently set forth and described in Section 4-402 of the New York Village Law and the Clerk's responsibilities may be expanded by resolution of the Village's Board of Trustees from time to time. The duties of the Village Clerk shall include:
1. Custody of Books and Records. Maintaining custody of the village seal books, records and papers of the Village and all the official reports and communications of the Board of Trustees. The Village Clerk is designated as records management officer pursuant to the Education Law, and is the records access officer for purposes of the New York Freedom of Information Law. It is further specifically understood that the Village Clerk is the registrar of vital statistics of the Village of Ilion.
2. Responsibility for Minutes. The Village Clerk shall act as the Clerk of the Village Board of Trustees and of all other boards (e.g. Planning board, zoning board of appeals. etc.) Unless a separate clerk is designated. Even in those instances where someone other than the Village Clerk is designated as the clerk of a given board, the Village Clerk shall remain primarily responsible for ensuring that minutes of those meetings are prepared correctly within the established time limits.
3. Local Legislation. The Village Clerk shall maintain all village resolutions and local laws.
4. Order to Pay Claims. The Village Clerk shall prepare, sign and transmit to the Chief Financial Officer (who is designated as the Treasurer of the Village) an order directing the CFO to pay all claims ordered paid by the Board of Trustees. The order must contain an abstract of all claims audited and ordered paid by the Board of Trustees, showing the names of all claimants, the amounts approved for payment and the appropriations chargeable. A duplicate of this order must also be filed in the office of the Village Clerk.
5. Transmitting Funds. The Village Clerk shall transmit all money belonging to the Village received by the Village Clerk to the Village's Chief Financial Officer on or before the tenth day of the next succeeding month.
6. Production of Books and Records. The Village Clerk shall produce books, records and papers for inspection. The Clerk must also furnish copies, certified in proper form to be read into evidence at a rate of $.20 per page
7. Notice of Defect. The Village Clerk shall keep an indexed record of all written notices of defect, which are reported pursuant to current Village Law Section 6-628.
8. Oath of Office. The Village Clerk may administer the oath of office to Village officers.
C-21. B: Treasurer
The Treasurer of the Village of Ilion shall be appointed by the Mayor, with the approval of a majority of the Village Board, and the Treasurer's appointment shall be for a period of four (4) years. The duties of the Treasurer shall include the following:
1. He or she shall collect all Village taxes and assessments, as well as all bills for electric and water service provided to residential and commercial customers.
2. He or she shall be the chief fiscal officer, office manager, and budget officer of the Village of Ilion.
3. He or she shall prepare the annual estimate, compute the tax rate and submit monthly budget status reports to the Board of Trustees.
4. He or she shall be in charge of the municipal building.
5. He or she shall receive all moneys belonging to the Village and keep an accurate account of all receipts and expenditures.
6. He or she shall deposit all funds belonging to the Village of Ilion under his or her charge in such bank or banks as the Board of Trustees may from time to time prescribe.
7. He or she shall maintain the cashbook, revenue ledger and appropriation ledger and shall reconcile all bank balances.
8. He or she shall oversee all of the Village's investments.
9. He or she shall execute capital raising strategies to support Village expansion.
10. He or she shall, before entering upon the duties of Chief Financial Officer of the Village of Ilion, and no later than ten ( 1 0) days following his or her hiring, give a bond to the Village by its corporate name for the faithful discharge of his or her duties.
11. He or she shall perform any and all additional duties and functions described under the job description for "Village Treasurer" as set forth in Section 4-408 of the New York Village Law, as amended from time to time, and shall perform such other duties not inconsistent with his or her office, as shall be determined by the Village's Board of Trustees.
