Chapter 31, PLANNING BOARD
§ 31-1. Establishment; membership; terms of office
There is hereby established a Planning Board consisting of five (5) members, two (2) of whom may be officials of the village. The terms of office shall be for five (5) years, except that those first appointed under the provisions of this chapter shall be for such terms not more than five (5) years as shall integrate with the terms of successors to other members of such Board now in office in such manner that, after the expiration of the terms of office of members now in office, the term of one (I) member shall expire each year. The members of the present Planning Board shall remain in office until the end of the term for which they were appointed and until their successors have been appointed as provided herein.
§ 31-2. Appointment of members and Chairman
A. The Board of Trustees shall appoint the members of the Planning Board.
B. The Board of Trustees shall designate a member of the Planning Board to act as Chairman thereof; or on failure so to do; the Planning Board shall elect a Chairman from its own members.
§ 31-3. Compensation of members
Members shall receive no compensation for their services as members of the Planning Board. Any village official who shall serve as a member shall not, however, forfeit his right to compensation in the performance of his office.
§ 31-4. Powers and duties
The Planning Board shall have and exercise all powers and duties as may be established by the
Board of Trustees by local law or resolution in addition to the following:
A. To employ experts and staff and to pay for their services and such other expenses as may be necessary and proper, not exceeding in all the appropriation that may be made for such Board.
B. To adopt rules and regulations in respect to procedure before it and in respect to any subject matter over which it has jurisdiction, subject to approval by the Board of Trustees.
C. To prepare and change a Comprehensive Master Plan for the development of the entire area of the village in accordance with all other provisions of law.
D. To make investigations, maps and reports and recommendations.
E. To approve plats as provided in this Code.
F. To advertise and hold public hearings on any matter before it.
§ 31-5. Reports on matters referred to Planning Board
No final action shall be taken by any public body or official of the village having final authority thereon upon any matter or class of matters referred to the Planning Board as required in any provision of this Code or any other provision of law until the Planning Board has reported thereon or until expiration of ninety (90) days, unless otherwise specifically provided.
§ 31-6. Official Map changes
Before making any changes in the Official Map of the village so as to lay out new streets, highways or parks or to widen or close existing streets, highways or parks, the matter shall be referred to the Planning Board for report thereon; but if the Planning Board shall not make its report within thirty (30) days of such reference, it shall forfeit the right to further suspend action.
