ARTICLE I. Village of Ilion Parks
§163-1. Title
This Article shall be known and may be cited as the “Local Law Regulating the Use of Village of Ilion Parks.”
§163-2. Purpose
The purpose of this Article is to protect the public health, welfare and safety in the use of all Parks in the Village of Ilion, which will promote the safe and proper use of the Parks for recreation purposes and will minimize detrimental effects of such use on the environment.”
§163-3. Definitions
The terms, words and phrases used in this Article as they relate to snowmobiles shall have the same meanings as such terms, words and phrases are defined in §21.05 of the Parks, Recreation and Historic Preservation Law.
“Parks” as used in this Article shall include Russell Park, Community Park, the South Fifth Avenue Athletic Fields, the Marina, and any other Village Park that exists or may come into existence in the future, as well as their parking lots, buildings, fields, playgrounds, tennis courts, and all real property upon which the Parks are located.
§163-4. General regulations
A. No open fires shall be permitted in the Parks except in picnic stoves or fireplaces provided for that purpose in designated picnic areas.
B. No person shall carry or discharge firearms or hunt in the Parks.
C. No abusive, profane or indecent language or noise or conduct that may annoy, disturb or interfere with the rights of others shall be engaged in.
D. Littering of any kind is hereby prohibited, and no trash, refuse or garbage shall be deposited in any area of the Parks except in cans or containers provided for such purpose.
E. No person shall carry or have in his possession any glass beverage container.
F. Smoking is expressly prohibited within any Park. Smoking shall be allowed at authorized wet slips, transient slips, and recreational vehicle sites located at the Marina. "Smoking" means inhaling, exhaling, burning or carrying any lighted cigar, cigarette, pipe, or any form of lighted object or device which contains tobacco or cloves.
§163-5. Penalties for offenses
Any person committing an offense against any provision of this Article shall be guilty of a violation and, upon conviction thereof, shall be punishable for each offense by a fine of not more than two hundred fifty dollars ($250.) or by imprisonment for not more than fifteen (15) days, or both.
