ARTICLE V, Miscellaneous Provisions
§ 239-24. Penalties for offenses.
A) Every person convicted of a traffic infraction for a violation of any provision of this Part 1 which is not a violation of any provision of the Vehicle and Traffic Law of the State of New York shall, for a first conviction thereof, be punished by a fine of not more than fifty dollars ($50.) or by imprisonment for not more than fifteen (15) days, or by both such fine and imprisonment; for a second such conviction within eighteen (18) months thereafter, such person shall be punished by a fine of not more than one hundred dollars ($100.) or by imprisonment for not more than forty-five (45) days, or by both such fine and imprisonment; upon a third or subsequent conviction within eighteen (18) months after the first conviction, such person shall be punished by a fine of not more than two hundred fifty dollars ($250.) or by imprisonment for not more than ninety (90) days, or by both such fine and imprisonment.
B) Parking tickets.
(1) The owner and/or operator of any motor vehicle illegally parked upon the roadways, streets, alleys or upon private of public properties within the Village of Ilion may, within five (5) days (excluding weekends and holidays) of the time when a notice, appearance ticket, summons or a parking ticket indicating such illegal parking was attached to such vehicle, pay to the Traffic Violations Bureau Clerk, as a penalty for and in full satisfaction of such violation, the following fees for any violation of this Part 1 of Chapter 239 of the Code of the Village of Ilion and/or the New York State Vehicle and Traffic Law violated
a) Abandoned Vehicle: twenty-five dollars ($25.)
b) Overtime Limits: twenty-five dollars ($25).
c) No Parking Anytime Zone: twenty-five dollars ($25).
d) Restricted Parking Zone: twenty-five dollars ($25.).
e) Handicapped Parking Zone: fifty dollars ($50.) additional thirty ($30) surcharge;
f) Improper Parking: twenty-five dollars ($25.).
g) Parking on a Median: twenty-five dollars ($25.).
h) Double Parking: twenty-five dollars ($25.).
i) Obstructing Traffic: twenty-five dollars ($25.).
j) Blocking Intersection: twenty-five dollars ($25.).
k) Blocking Crosswalks or Sidewalks: twenty-five dollars ($25.).
l) Blocking Driveway: twenty-five dollars ($25.).
m) Blocking Loading Zone: twenty-five dollars ($25.).
n) Blocking Snow Emergency Routes: twenty-five dollars ($25.).
o) Blocking or Parking too Close to Fire Hydrants: twenty-five dollars ($50.).
p) Unregistered Vehicles: fifty dollars ($50.).
q) Uninspected vehicles: thirty dollars ($30.).
r) Parking on Wrong Side of Street or Roadway: twenty-five dollars ($25.).
s) Parking in or Blocking Fire Zone: twenty-five dollars ($55.).
t) No Standing: twenty-five dollars ($25.).
u) Parking Between Walk & Curb: twenty-five dollars ($25.).
v) All Night Parking: twenty-five dollars ($25.).
w) Any and all other parking violations: twenty-five dollars ($25.).
(2) The failure of such owner and/or operator to make such payment within said five (5) days (excluding weekends and holidays) will result in said fees being raised as follows:
i) All five-dollar tickets shall become ten-dollar tickets.
ii) All ten-dollar tickets shall become twenty-dollar tickets.
iii) All fifteen-dollar tickets shall become thirty-dollar tickets.
iv) All twenty-five-dollar tickets shall become fifty-dollar tickets.
v) All fifty-dollar tickets shall become one-hundred-dollar tickets.
(3) The failure of such owner and/or operator to make such payment within thirty (30) days from the date of issue (excluding weekends and all holidays) shall result in said fees being raised as follows:
i) All five-dollar tickets shall become twenty-dollar tickets.
ii) All ten-dollar tickets shall become forty-dollar tickets.
iii) All fifteen-dollar tickets shall become sixty-dollar tickets.
iv) All twenty-five-dollar tickets shall become seventy-five-dollar tickets.
v) All fifty-dollar tickets shall become one-hundred-fifty-dollar tickets.
(4) The penalties imposed by this subsection shall not be in excess of those imposed according to the New York State Vehicle and Traffic Law.
