Chapter 59, AMUSEMENT CENTERS
GENERAL REFERENCES
Games of chance-- Sec Ch. 131.
§ 59-1. Definitions
Whenever used in this chapter, unless otherwise expressly stated or unless the context or subject matter requires a different meaning, the following terms shall have the respective meanings hereinafter set forth:
AMUSEMENT CENTER-- Any indoor place or enclosure in which is maintained or operated for the amusement, patronage or recreation of the public any coin-operated amusement device of any description and particularly, but not by way of limitation, the types commonly known as "bagatelle games," "baseball," "football" and "pinball amusement games."
OWNER OR OPERATOR OF AN AMUSEMENT DEVICE-- Any person, who owns, places, distributes or locates a coin-operated amusement device in any place in which it is operated for the amusement, patronage or recreation of the public.
§ 59-2. License required
No person shall maintain or operate an amusement center without first having obtained a license to do so, and the licensee shall be of good moral character and shall maintain good order therein.
§ 59-3. Issuance, suspension and revocation of license
The Mayor or his designated representative may issue or suspend a license for the maintenance and operation of amusement centers, and said license may be revoked by the Board of Trustees, but no such license shall be issued until the application of the applicant has been approved by the Chief of Police.
§ 59-4. Location restricted near schools
No license shall be granted for any such amusement center located within two hundred (200) feet of a public or private school, measured in a straight line from the street entrance of such school to the street entrance of such amusement center.
§ 59-5. Cash awards prohibited
No cash awards shall be made in any contest, tournament, league or individual play on any game maintained or operated in any amusement center, and no device shall be permitted to operate if said device delivers to the player or ejects coins or slugs or metal tokens or paper slips on certain scores or if said device may be readily converted to deliver to the player or eject coins or slugs or metal tokens or paper slips.
§ 59-6. Amusement center license fee
The fee for the license of an amusement center shall be as determined by resolution of the Village Board for each game operated therein, and said license shall expire on the 31st day of January next succeeding the date of issuance thereof Should a license be desired for a period commencing on or after the 31st day of July of any particular year, the license fee shall be as determined by resolution of the Village Board for the balance of the year to the 31st day of January next succeeding.
§ 59-7. Operators’ license; fee
A. License required by owner or operator. Every owner or operator of a coin-operated amusement device shall be required to obtain a license as hereinafter provided.
B. License of owners or operators. The Mayor may issue a license for owners or operators of coin-operated amusement devices upon payment of the fee as provided herein, and said license may be revoked by the Board of Trustees, but no such license shall be issued until approved by the Chief of Police.
C. License fee for owners or operators. The license fee for owners or operators shall be as determined by resolution of the Village Board per year or any part thereof each device placed in every amusement center in the village.
§ 59-8. Identification of devices
Owners or operators so licensed shall be required, before placing such devices in any amusement center, to submit the same to the Chief of Police for identification, numbering and scaling in such manner as he shall require.
§ 59-9. Substitution of devices
Any device may be substituted by the owner or operator, without additional fee, under the license then in existence, provided that such device proposed to be so substituted is submitted to the Chief of Police for identification in the manner heretofore provided for devices in the first instance.
§ 59-10. Expiration of operator’s license
Licenses for owners or operators of amusement center devices shall expire on the 31st day of January next succeeding the date of issuance thereof.
§ 59-11. Restrictions on issuance of licenses
No license shall be issued under this chapter to any person who has been convicted of a crime or of any gambling offense against the laws of the State of New York, and in the event of any such conviction subsequent to the issuance of said license, said license shall be immediately revoked.
§ 59-12. Penalties for offenses
Any person committing an of1cnse against any provision of this chapter shall be guilty of a violation and, upon conviction thereof shall he punishable for each offense by a fine of not more than two hundred fifty dollars ($250.) or by imprisonment for not more than fifteen ( 15) days, or both.
