ARTICLE II, OFFICERS
C-3. Enumeration.
The officers of said village shall be:
A. A Mayor and four (4) Trustees, who shall comprise the Board of Trustees of said village. Annually, the Mayor shall appoint one (1) of the Trustees as Acting Mayor, who, during the absence or inability of the Mayor, is vested with all of the powers and may perform all of the duties of the Mayor.
B. A Clerk
C. An Administrator.
D. A Village Justice.
E. A Chief of Police.
F. A Fire Chief.
G. Five (5) Library Trustees who shall constitute the Board of Trustees of the Ilion Free Public Library.
H. A Treasurer
C-4. Qualifications.
A. The Mayor and Trustees shall all be residents of and freeholders in said village, and the Mayor and Trustees, together with the Village Justice, shall all be elected by ballot by the electors of said village, and the Clerk, Treasurer, Chief of Police and Fire Chief shall be appointed by the Board of Trustees of said village, and the officers so appointed shall hold their offices, respectively, during the pleasure of the Board of Trustees and until their successors shall have been appointed and have qualified.
C-5. Residency requirement.
No person shall be eligible to serve as Clerk, Treasurer, Fire Chief or Police Chief of the Village of Ilion unless he or she shall, at the time, be a resident of Herkimer County; and whenever such person shall cease to be a resident of Herkimer County, his or her office shall thereby become vacant. Any and all other officers of the Village must be Village residents. Whenever any officer, other than the Clerk, Treasurer, Fire Chief or Police Chief shall cease to be a resident of the Village of Ilion, his or her office shall become vacant.
C-6. Election.
A. Qualifications of electors. At all elections of officers in said village, every person qualified to vote for town officers in the town in which said village, or any part of said village, is or shall be situated and who is a resident of the Village of Ilion may vote for all of the officers to be chosen by ballot. Persons eligible and having the greatest number of votes shall be duly elected.
B. Notification of election. Every person elected at any such election whose name shall have been entered as a voter on the poll list kept thereat shall be deemed notified of his election, and every person so elected whose name shall not have been so entered shall be notified of his election within ten (10) days thereafter by the Clerk of said village.
C. Time and notice of election. The first election of officers under this act shall be held on the third Tuesday of June next after it shall go into effect, and the annual election shall be held thereafter on the third Tuesday of June in each year at such places in said village as shall be designated by the Board of Trustees, and one (1) week's notice of such election and the places thereof shall be given by publishing the same in all the newspapers printed in said village, and in case there shall be no such newspaper printed, then by posting such notice in six (6) public places in said village.
C-7. Oath of office.
A. Oath required. Every person, except the Village Justice, who shall be elected or appointed to any office shall, before he enters upon the discharge of the duties thereof, take and subscribe such oath or oaths as are or may be required by the Constitution of the state, which shall be filed with the Clerk of the village and which may be taken before and certified by any officer authorized to administer oaths.
B. Failure to take and file oath. If any person, except the Village Justice, who shall have been duly elected or appointed to any office in said village shall, for five (5) days after having been notified of such election or appointment, neglect or refuse to take the oath or oaths of office or to file the same with the Clerk of said village, his office shall thereupon become vacant.
C-8. Vacancies.
If any vacancy shall occur in any office in said village, an elector of said village, having the other requisite qualifications, may be appointed to fill the vacancy, and the person so appointed shall hold the office, if an elective one, until the next annual election and until his successor shall have qualified. Such appointment may be made by the Board of Trustees, provided that if the Board of Trustees fails to make such appointment within a period of thirty (30) days after such vacancy occurs, then such appointment may be made by the Mayor or if the office of the Mayor is vacant, then by the Acting Mayor.
